The Allahabad High Court Bar Association has strongly criticized the Supreme Court Collegium’s decision to transfer Delhi High Court Judge Justice Yashwant Varma back to the Allahabad High Court following the alleged recovery of unaccounted cash from his residence.

Bar Association Condemns Transfer Decision
In a strongly worded four-page letter, the Bar Association asserted that the Allahabad High Court is “not a trash bin” and would not tolerate corruption. The letter raised concerns about the current judicial crisis due to a shortage of judges, leading to delays in fresh case hearings. It emphasized that despite these challenges, the judiciary must uphold the highest standards of integrity.
“Presently, we are facing so many problems, particularly the shortage of judges, resulting in fresh cases not being heard for months, thereby diminishing public faith in the rule of law. But it does not mean that we are a trash bin. We are not ready to accept corruption,” the letter stated.
Cash Recovery Sparks Controversy
Reports suggest that a significant sum of cash was discovered at Justice Varma’s residence following a fire incident last week. First responders, upon extinguishing the fire, reportedly found the cash inside a room and alerted authorities, leading to high-level discussions within the judiciary.
Following the discovery, the Supreme Court Collegium, headed by Chief Justice of India Sanjiv Khanna, decided to transfer Justice Varma to the Allahabad High Court. The move has sparked debate within legal circles, with concerns over judicial accountability and transparency.
Legal Community Reacts
Former Supreme Court Bar Association (SCBA) president Adish Aggarwala expressed skepticism over the allegations, stating that while judicial transfers are common, the circumstances surrounding this case are suspicious.
“Transfer is a normal thing and not a stigma. I am not admitting that there can be a situation of corruption because I feel that sometimes, people who are not getting favorable results may also plant [evidence]. Here, I feel, when the judge himself and his family members were not there and such a thing happened, including the fire incident and video being made, there is suspicion,” Aggarwala told Times of India.

The controversy surrounding Justice Varma’s transfer has reignited discussions on judicial transparency and the need for a more robust mechanism to address allegations against sitting judges. Legal experts argue that while judicial transfers are standard procedure, the lack of clarity in such cases fuels speculation and erodes public trust in the judiciary.
