Bombay High Court Notifies Special Courts for Trial of Paper Leak Cases Under Public Examinations Act, 2024

The Bombay High Court has designated Special Courts across Maharashtra to exclusively try offences registered under the Public Examinations (Prevention of Unfair Means) Act, 2024, a law enacted to combat paper leaks and other malpractices in public examinations.

The notification marks an important step towards ensuring the effective implementation of the 2024 legislation by facilitating the speedy trial of cases involving examination fraud, including question paper leaks, impersonation, unauthorized access to examination materials, and organised cheating syndicates.

The designated courts will exercise jurisdiction over offences punishable under the Act within their respective territorial limits. The objective is to enable expeditious disposal of prosecutions arising from public examination-related offences and strengthen judicial oversight in cases that have significant implications for the integrity of recruitment and admission processes.

Background: Public Examinations (Prevention of Unfair Means) Act, 2024

The Public Examinations (Prevention of Unfair Means) Act, 2024 was enacted following a series of paper leak incidents that disrupted recruitment examinations and competitive entrance tests across the country. The legislation seeks to preserve the fairness, transparency, and credibility of public examinations by creating a dedicated statutory framework to address organised examination fraud.

The Act criminalises a range of unlawful activities, including paper leaks, tampering with examination processes, unauthorized disclosure of confidential examination material, impersonation, and other unfair means adopted to manipulate public examinations. It also provides for stringent penal consequences against individuals and organised groups involved in such offences.

Significance of Special Courts

The designation of Special Courts is expected to expedite criminal proceedings under the Act by ensuring that such matters receive focused judicial attention. Dedicated courts generally help reduce procedural delays, improve consistency in adjudication, and enable the timely disposal of cases involving specialised legislation.

Given the increasing number of examination-related fraud cases in recent years, the establishment of Special Courts is likely to strengthen the enforcement mechanism envisaged under the 2024 Act and enhance public confidence in the examination system.

Paper leak incidents have repeatedly affected government recruitment drives and admissions to educational institutions, impacting lakhs of candidates across the country.
