No Adverse Orders Amid Heavy Rains in Jodhpur: Rajasthan High Court Advocates Association Urges

The Rajasthan High Court Advocates Association (RHCAA) has submitted a formal representation to the Hon’ble Registrar General of the Rajasthan High Court, urging consideration for advocates who may be unable to attend court proceedings due to the heavy and continuous rainfall in Jodhpur and surrounding areas.

In the letter, signed by Association President Ratana Ram Tholiya and General Secretary Shiv Lal Barwar, the RHCAA highlighted that Jodhpur has been witnessing severe monsoon showers for the past few days. The downpour has led to severe waterlogging on roads, disrupting normal traffic movement and making it extremely difficult for advocates to reach the court premises on time.

The Association emphasized that if any advocate was unable to appear before the Rajasthan High Court or subordinate courts on September 1, 2025, their absence should not be held against them. Instead, it requested that no “adverse or ex-parte orders” be passed in cases where lawyers could not be present due to the weather-related disruption.

The letter further clarified that the intent behind this representation is to safeguard the interests of litigants as well. Since lawyers are unable to attend proceedings under these extraordinary circumstances, the Association requested that the courts issue directions ensuring no prejudice is caused to their clients.

Quoting from the representation, the RHCAA wrote:
“In view of the heavy rains on September 1, 2025, if any advocate is unable to attend proceedings, they should be granted relief from strict procedural consequences, and adverse orders should not be passed in their absence.”

This appeal reflects the broader concern of the legal fraternity about ensuring fair opportunity and protection of litigants’ rights during natural calamities and extraordinary weather conditions. The RHCAA has requested the Hon’ble High Court to issue necessary directions immediately.
