SSI Limit Not Crossed; No Evidence Supported Clandestine Removal: CESTAT Quashes Excise Duty Demand

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Kolkata has set aside the entire duty demand, penalties and confiscation ordered against a Hajipur-based PVC pipe manufacturer after ruling that the adjudicating authority violated principles of natural justice and failed to establish any evidence of clandestine removal. The bench of R. Muralidhar (Judicial Member) and K. Anpazhakan (Technical Member) observed that duty cannot be demanded on the basis of assumptions or loose private records unless supported by independent corroborative evidence. The case originated from a search conducted by the Central Excise (Preventive) unit on March 30, 2006. During the search, officers seized 30,680 kg of PVC pipes valued at ₹16 lakh, alleging improper maintenance of statutory records. They also recovered several loose sheets, diaries and rough estimate notebooks, which the department later relied upon to allege that the factory had suppressed production and crossed the SSI exemption threshold under Notification No. 8/2003-CE. Based entirely on the notebook entries, the department added a notional clearance value of ₹85.95 lakh to the company’s recorded turnover of ₹1.18 crore and calculated total clearances at ₹2.04 crore for FY 2005–06. This resulted in a substantial duty demand of ₹16.65 lakh, an additional duty of ₹2.56 lakh on seized goods, and penalties on the company, its director and supervisor. During adjudication, the company repeatedly requested copies of the seized and relied-upon documents through letters dated September to December 2007. However, the Tribunal noted that there was no evidence that the department ever supplied these documents. Despite this, the adjudicating authority proceeded to pass an ex-parte order confirming the duty demand and imposing penalties. When recovery was initiated, the company approached the Patna High Court, which directed that a certified copy of the order be provided. The appellants argued that without access to the seized documents, they were denied a fair opportunity to defend the allegations. They also submitted that the department had not conducted any verification to establish clandestine production—such as identifying transporters, buyers, cash flows, excess consumption of raw materials or electricity, or any delivery of goods to customers. They contended that rough notebooks could not be treated as proof of actual clearances, and that their actual recorded turnover remained within the SSI limit. The Tribunal accepted these arguments, observing that non-supply of relied-upon documents constituted a clear breach of natural justice. It stated that an adjudication order passed without giving the affected party access to the documents used against them is inherently void. On merits, the Tribunal found that the department did not carry out any investigation to show excess manufacture or removal of goods. There was no evidence of unaccounted purchases of raw materials, no records of transportation of alleged clandestine clearances, and no statements or documents from any buyers. Electricity consumption was also not examined, a factor often used to assess actual manufacturing activity. As such, the Tribunal concluded that inclusion of the ₹85.95 lakh based solely on “rough estimate” books was completely unsustainable. With this addition deleted, the company’s turnover remained at ₹1.18 crore, which was well within the SSI exemption limit applicable at the time. Consequently, the Tribunal set aside the entire duty demand, including the duty calculated on the goods found during the search, holding that SSI benefit could not be denied. The confiscation of the seized goods was also quashed. Since the duty demand itself did not survive, the Tribunal ruled that interest and penalties on the company also could not be sustained. Penalties imposed on the director and supervisor were likewise set aside, with the Bench noting that there was no evidence to suggest their involvement in any alleged wrongful activity. In conclusion, the Tribunal allowed all the appeals and granted consequential relief, firmly reiterating that tax authorities must base demands on substantiated evidence and cannot rely on private notes or estimated values without proper investigation.
