Service Tax on Cylinder Retention Charges: CESTAT Says Appeal Can’t Be Dismissed for Curable Defects

The Customs, Excise & Service Tax Appellate Tribunal (CESTAT), Ahmedabad Bench, has held that an appeal cannot be dismissed merely on technical or curable defects without examining the merits of the case. The bench of Somesh Arora (Judicial Member) and Satendra Vikram Singh (Technical Member) remanded the matter back to the Commissioner (Appeals) for fresh adjudication after allowing the assessee an opportunity to rectify such defects. The case involved AIMS Industries Limited, a company engaged in the supply of gas cylinders. The dispute arose over service tax liability on “retention charges” collected from customers who delayed returning empty gas cylinders beyond a stipulated free period. The Department had treated such charges as consideration for “supply of tangible goods service” and raised a demand of ₹4.88 lakh along with interest and penalties under the Finance Act, 1994. The original adjudicating authority confirmed the demand along with equal penalty under Section 78 and an additional penalty under Section 77. The Commissioner (Appeals) upheld this order, but notably dismissed the appeal on technical grounds without entering into the merits of the case. The defects cited by the Commissioner (Appeals) included absence of proper contact details, lack of clarity regarding authorization of the signatory, discrepancies in the appeal documentation, and procedural irregularities in representation. Further, multiple personal hearing dates were fixed within a short span, and the appellant’s request for disposal without hearing was also taken adversely. Before the Tribunal, the appellant argued that such defects were procedural and curable in nature, and the appeal should not have been rejected outright. It was also contended that the issue of taxability of retention charges had already been settled in their favour in earlier cases, including their own matters. On the substantive issue, the appellant maintained that the cylinders remained under the effective control and possession of the customers during the retention period. Therefore, the essential condition for classification under “supply of tangible goods service”—i.e., retention of effective control by the service provider—was not satisfied. The Department, on the other hand, argued that allowing customers to retain cylinders beyond the free period for a consideration constituted a taxable service, and that ownership and effective control continued to remain with the appellant as per contractual terms. However, the Tribunal chose not to delve into the merits at this stage. Instead, it focused on the legality of dismissal of the appeal on technical grounds. The Bench comprising Mr. Somesh Arora (Judicial Member) and Mr. Satendra Vikram Singh (Technical Member) observed that the defects pointed out were clearly curable and should have been allowed to be rectified in the interest of justice. The Tribunal strongly disapproved the approach of rejecting appeals for such procedural lapses, particularly when no adequate opportunity was given to the appellant to cure the defects. It also noted that granting three hearing dates within a span of just seven days was not in consonance with the principles of natural justice. The Tribunal reiterated that procedural defects like improper authorization or missing signatures are not fatal and cannot be grounds for outright rejection of appeals. Such deficiencies must be treated as curable, and appellants must be given a fair opportunity to rectify them. The Tribunal set aside the impugned order and remanded the matter to the Commissioner (Appeals) with directions to allow the appellant to correct the defects and thereafter decide the case afresh on merits, in accordance with law and principles of natural justice.
