End-Use Can’t Decide Customs Classification: CESTAT Quashes Reclassification of Aluminium Tubes, Profiles as ‘Auto Parts’

The Principal Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT), New Delhi, has set aside a major customs demand holding that aluminium tubes, pipes and profiles imported by the company cannot be reclassified as motor vehicle parts merely on the basis of their intended end-use. The bench of Justice Dilip Gupta (President) and Hemambika R. Priya (Technical Member) has observed that classification must be determined based on the condition of goods at the time of import and their specific tariff description, not on how they are eventually used in manufacturing. The case arose from imports made during April 2015 to March 2016, wherein Hanon Climate Systems imported aluminium tubes, aluminium pipes (including receiver dryer pipes), aluminium profiles and aluminium articles used as inputs for manufacturing engine cooling modules (ECM), radiators, condensers and charge air coolers. The importer classified these goods under Chapter 76 of the Customs Tariff Act, 1975—specifically under headings 7604 (aluminium profiles), 7608 (aluminium tubes and pipes) and 7616 (other articles of aluminium)—and claimed exemption from Basic Customs Duty under applicable customs notifications. However, following an audit, the Customs Department alleged that the goods were specially designed for use in automobile radiators and cooling systems and therefore ought to be classified under Heading 8708, covering “parts and accessories of motor vehicles.” On this basis, the Department invoked the extended period of limitation under Section 28(4) of the Customs Act, demanded differential duty with interest, and imposed penalties under Sections 114A and 114AA. The Department argued that the imported items bore specific part numbers linked to automobile components and were meant exclusively for captive consumption in motor vehicle assemblies, making them identifiable auto parts at the time of import. The assessee contended that the goods were plain aluminium inputs in their imported condition, requiring substantial processing—such as cutting, drilling, brazing, fin insertion and assembly—before they could become components of any radiator or condenser. The company emphasized that end-use is irrelevant for tariff classification when the heading is based on product description. After an exhaustive analysis of Chapter Notes, Section Notes, tariff entries and judicial precedents, the Tribunal accepted the assessee’s submissions. It held that aluminium tubes and pipes imported with uniform cross-section clearly fall within the definition provided under Chapter 76, even if cut to size. Aluminium profiles and RD pipes did not assume the character of identifiable motor vehicle parts at the time of import. RD tanks, in their imported form, were merely aluminium structures requiring further processing and could not be treated as parts of motor vehicles. The Tribunal categorically rejected the Department’s reliance on end-use, reiterating the settled principle that classification must be based on the description and condition of goods at the time of import, not on how they are ultimately used in manufacturing. CESTAT further observed that for goods to fall under Heading 8708, they must cumulatively satisfy three conditions under the Explanatory Notes to Section XVII they should not be excluded by Section Notes, they must be suitable for use solely or principally with motor vehicles, and they should not be more specifically covered elsewhere in the tariff. The Tribunal held that Hanon’s imported goods failed on all three counts, as they were generic aluminium products with wide industrial application and were more specifically covered under Chapter 76. The Tribunal also ruled that the extended period of limitation was wrongly invoked. It noted that the dispute was purely one of classification and interpretation of tariff entries. There was no suppression or misstatement of facts by the importer. The Commissioner himself had dropped confiscation proceedings, acknowledging that there was no concealment regarding end-use. The CESTAT quashed the Commissioner’s order dated 30 April 2021 and restored the original classification under Chapter 76, also upholding the assessee’s entitlement to customs duty exemption under the relevant notifications.
