Cross-Examination Not Absolute Right | Delhi High Court Upholds Penalty In Gutkha Manufacturing Case

The Delhi High Court while upholding Rs. 50 lakh penalty in gutkha manufacturing case, held that denial of cross-examination of witnesses is not an absolute right as it does not automatically violate principles of natural justice where sufficient independent evidence exists on record. The bench of Justice Nitin Wasudeo Sambre and Justice Ajay Digpaul has observed that the adjudication order was based not only on statements of witnesses but also on independent evidence such as seizure of gutkha pouches, packaging material and machinery, documents and records recovered during searches, electricity consumption data indicating manufacturing activity, and other corroborative materials collected during the investigation. The dispute arose from an investigation by Central Excise authorities into the operations of M/s M.R. Tobacco Pvt. Ltd., a company engaged in the manufacture of gutkha products. The company had earlier obtained Central Excise registration for its manufacturing unit located at Samaypur Badli in Delhi. Authorities alleged that despite the factory machinery being sealed, gutkha manufacturing activities were clandestinely carried out from another premises at Libaspur, Delhi, using packaging and sealing machines without obtaining the required registration or paying excise duty. During a search conducted on 11 October 2009, officials discovered two gutkha pouch packing machines, sealing plates, ready-mix masala, packaging materials, and finished gutkha pouches at the Libaspur premises. Goods and machinery valued at approximately ₹7.99 lakh were seized. The investigation also led to the recording of statements of several individuals including workers, contractors and other persons connected with the manufacturing operations. Documents, electricity consumption records and other materials were also collected during the investigation. Based on the investigation, a show cause notice was issued alleging clandestine manufacture and removal of gutkha between July 2008 and October 2009. The adjudicating authority eventually confirmed a central excise duty demand of ₹5.87 crore against the company along with interest and an equivalent penalty. It also imposed separate penalties on several individuals, including a ₹50 lakh penalty on Himanshu Gupta under Rule 26 of the Central Excise Rules, 2002. Gupta challenged the order before the CESTAT, but the tribunal dismissed his appeal. He subsequently approached the Delhi High Court under Section 35G of the Central Excise Act, 1944. The appellant argued that the adjudication and the tribunal’s order were primarily based on statements of witnesses recorded during the investigation. He contended that the authorities had failed to provide copies of certain documents relied upon in the show cause notice. He was denied the opportunity to cross-examine witnesses whose statements were used against him. Such denial violated the statutory requirement under Section 9D of the Central Excise Act and the principles of natural justice. The department argued that the case was not based solely on witness statements but was supported by substantial independent evidence, including seizures, electricity consumption records, documents recovered during searches, and other corroborative materials. They further submitted that the right to cross-examination is not absolute and can be denied in appropriate circumstances. The bench also observed that the witnesses whose statements were relied upon included employees and co-noticees who had financial or employment connections with the appellant. The Court held that the authorities were justified in concluding that cross-examination would not materially alter the evidentiary position. The Court reiterated that while cross-examination can be an important procedural safeguard, it is not an absolute or unfettered right in every case. Its applicability depends on the facts of each case and the nature of the evidence relied upon. The court emphasised that principles of natural justice are flexible and must be applied in a manner suited to the circumstances of each case rather than as rigid procedural requirements. The Court concluded that the proceedings against the appellant were supported by adequate corroborative evidence and that denial of cross-examination in the present circumstances did not violate statutory or natural justice requirements.
