Can GST Arrestees Demand the Charge Sheet at the Time of Arrest? Bombay HC Answers

The Bombay High Court has held that the "grounds of arrest" required to be communicated at the time of arrest are distinct from the supply of the charge sheet and other prosecution documents. The Court clarified that an accused cannot insist on receiving copies of an earlier charge sheet or other documents relied upon during investigation by invoking the statutory requirement of communicating the grounds of arrest. The judgment assumes considerable importance not only in conventional criminal investigations but also in GST enforcement proceedings, where arrests under the Central Goods and Services Tax Act, 2017 (CGST Act) are frequently challenged on procedural grounds. Division Bench Clarifies Distinct Scope of Sections 50 and 207 CrPC A Division Bench comprising Justice Sandesh D. Patil and Justice Vrushali V. Joshi ruled that the obligation under Section 50 of the Code of Criminal Procedure, 1973 (now substantially reflected in Section 47 of the Bharatiya Nagarik Suraksha Sanhita, 2023) is limited to informing the arrested person of the grounds of arrest. The Court held that this obligation cannot be expanded to include supplying copies of an earlier charge sheet, witness statements, FIR, confessional statements, or other prosecution material contemplated under Section 207 CrPC. According to the Bench, Section 207 comes into operation only after a charge sheet has been filed against the concerned accused, whereas Section 50 governs the procedure immediately upon arrest. Since both provisions operate at different stages of criminal proceedings, they cannot be read interchangeably. Background of the Case The petitioner was originally the complainant in an FIR registered at Miraj Rural Police Station in July 2022. During investigation, the police filed a charge sheet against certain accused persons while keeping further investigation open against others. Subsequently, fresh material allegedly surfaced indicating the involvement of the original complainant himself. Based on this subsequent investigation, he was arrested on 15 April 2025. The petitioner admitted before the High Court that the police had communicated the grounds of arrest immediately after his arrest. However, he argued that the arrest was nevertheless illegal because the investigating agency had failed to furnish him with: the earlier charge sheet, witness statements, investigation documents, and other records forming the basis of the prosecution case. According to the petitioner, these documents formed part of the "grounds of arrest" and were necessary for him to effectively challenge his detention. Reliance on Supreme Court Judgments The petitioner relied upon the Supreme Court's landmark judgments in: Prabir Purkayastha v. State (NCT of Delhi), and Mihir Rajesh Shah v. State of Maharashtra, which emphasised that the grounds of arrest must be effectively communicated to the arrested person to enable meaningful exercise of constitutional and statutory rights. The petitioner argued that merely informing him of the reasons for arrest without supplying the underlying prosecution material defeated the purpose of these judgments. State's Stand The State opposed the writ petition, submitting that: the petitioner had admittedly received the grounds of arrest immediately upon arrest; Section 207 CrPC becomes applicable only after a charge sheet is filed against the concerned accused; and there was no legal obligation to provide copies of a charge sheet filed against other accused persons before that statutory stage arrived. High Court Rejects Expanded Interpretation The High Court accepted the State's submissions. After analysing Chapters V and XVI of the CrPC, the Bench observed that: Section 50 governs arrest procedure; Section 207 governs supply of documents after commencement of proceedings before the Magistrate. The Court observed that importing the obligations under Section 207 into Section 50 would amount to rewriting the statutory framework. The Bench held that the accused undoubtedly becomes entitled to receive copies of the police report and related documents once the stage under Section 207 arises. However, such entitlement cannot be advanced to the stage of arrest by treating those documents as part of the "grounds of arrest." Reliance on Supreme Court's Decision in State of Karnataka v. Sai Darshan The High Court also relied upon the Supreme Court's judgment in State of Karnataka v. Sai Darshan, reiterating that the legal requirement is to ensure that the arrested person understands why he is being arrested so that he can effectively pursue available legal remedies. The Court observed that procedural irregularities, without demonstrable prejudice, do not automatically invalidate the arrest or detention. Since the petitioner never disputed receiving the grounds of arrest, his challenge based solely on non-supply of Section 207 documents was held to be without merit. The writ petition was accordingly dismissed. The Court clarified that it had expressed no opinion on the merits of the criminal prosecution and that all legal contentions would remain open during bail proceedings or trial. Why This Judgment Matters for GST Arrests Although the case arose from a criminal investigation, its reasoning carries significant implications for GST arrests under Section 69 of the CGST Act. GST arrests have increasingly been challenged before High Courts and the Supreme Court on the ground that taxpayers were not informed of the reasons for arrest or were denied procedural safeguards. Recent judicial developments have consistently emphasised that GST authorities must comply with constitutional protections while exercising arrest powers. 1. Grounds of Arrest Must Be Communicated The Supreme Court in Prabir Purkayastha and Mihir Rajesh Shah has already recognised that the arrested person must receive clear communication of the grounds of arrest. Following these rulings, GST authorities across the country have revised arrest practices by serving written grounds of arrest contemporaneously with the arrest. The Bombay High Court now clarifies that this obligation does not extend to supplying the entire prosecution record at the arrest stage. 2. GST Officers Need Not Supply Investigation Records During Arrest Taxpayers frequently seek copies of: DGGI investigation reports, statements recorded under Section 70 of the CGST Act, seized documents, evidence collected during investigation, or internal case records. This judgment indicates that such documents do not automatically become part of the statutory "grounds of arrest." Unless specifically required under another statutory provision or judicial direction, GST authorities are not obliged to provide the entire investigation file merely because an arrest has been made. 3. Distinction Between Arrest Rights and Trial Rights The ruling reinforces an important procedural distinction. At the arrest stage, the person is entitled to know: why he is being arrested, under which statutory provisions, and the factual basis necessitating arrest. However, the right to receive the complete prosecution material arises later, when the prosecution reaches the stage contemplated by law. This distinction is equally relevant in prosecutions launched under the CGST Act after the filing of complaints before competent criminal courts. 4. Litigation Focus May Shift The judgment suggests that future challenges to GST arrests are more likely to succeed where authorities fail to: communicate proper grounds of arrest, record reasons for arrest, comply with constitutional safeguards under Articles 21 and 22, follow statutory arrest guidelines, rather than merely because all investigation documents were not supplied immediately.
