ITAT Quashes Nine S. 153C Assessments Over Defective Satisfaction Note and Limitation Issues

The Delhi Bench of the Income Tax Appellate Tribunal (ITAT) has quashed nine assessments framed under Section 153C of the Income Tax Act in the cases of two assessees, holding that the proceedings suffered from fundamental legal defects, including absence of a valid satisfaction note, limitation issues and failure to satisfy statutory monetary thresholds. The bench of Satbeer Singh Godara (Judicial Member) and Naveen Chandra (Accountant Member) has observed that taxing statutes require strict interpretation. It held that the statutory amendment consciously differentiated the terminology applicable to different categories of seized material and that such distinctions could not be ignored. The Bench relied upon the Third Member decision in Prashant P. Bafna v. ACIT and also referred to the Supreme Court judgment in Commissioner v. Dilip Kumar & Co. emphasizing strict interpretation of tax laws. The Tribunal concluded that the satisfaction note suffered from a legal defect and could not confer jurisdiction under Section 153C. As a result, all seven assessments against Vinod Kumar Maheshwari were declared non-est in law and were quashed. The appeals were filed by Vinod Kumar Maheshwari for Assessment Years (AYs) 2013-14 to 2019-20 and by Krishan Kumar Maheshwari for AYs 2014-15 and 2017-18 against orders passed by the Commissioner of Income Tax (Appeals). The proceedings arose from assessments made under Section 153C read with Section 143(3) following a search operation conducted under Section 132 on 18 October 2019 in the Alankit Group and connected cases. The principal controversy before the Tribunal concerned the legality of the Section 153C proceedings initiated against Vinod Kumar Maheshwari. The assessee argued that the mandatory satisfaction note recorded by the Assessing Officer was defective and therefore incapable of supporting jurisdiction under Section 153C. The Tribunal examined the satisfaction note dated 10 March 2022 recorded by the Assessing Officer of the searched person. It observed that the satisfaction note stated that the seized documents “belong to” a person other than the searched person. However, the Tribunal noted that after the amendment introduced by the Finance Act, 2015, the expression “belongs to” under Section 153C(1)(a) is intended for specific categories of seized assets such as money, bullion, jewellery or other valuable articles. In contrast, documents and books of account fall under the expressions “pertains to” or “relates to” under Section 153C(1)(b). The department contended that such terminology differences were procedural and that expressions such as “belonging to,” “pertaining to,” and “relating to” should be interpreted interchangeably. According to the Department, a liberal construction ought to be adopted so that proceedings are not invalidated merely because of wording used in the satisfaction note. The Tribunal found separate grounds for setting aside the assessments. In relation to AY 2014-15, the Tribunal observed that the Section 153C notice was issued on 16 May 2023 and that, under the computation mechanism prescribed under Section 153A Explanation 1, the assessment year fell beyond the maximum permissible period of ten years. Since the Revenue did not rebut this position, the assessment was quashed on limitation grounds. For AY 2017-18, the Tribunal noted that the disputed addition amounted to only ₹3.17 lakh, which was significantly below the pecuniary threshold limit of ₹50 lakh. Relying upon the Delhi High Court ruling in PCIT v. Ojjus Medicare Pvt. Ltd., the Bench held that the assessment could not survive and therefore quashed it as well.
