ITR Filing Extension: Punjab & Haryana HC Rebukes CBDT Counsel for Non-Compliance with Gujarat HC Order [WATCH VIDEO]

The Punjab and Haryana High Court has recorded the statement made by the Counsel for the Central Board of Direct Taxes (CBDT) that the necessary orders regarding the extension of the Income Tax Return (ITR) filing due date are likely to be issued by 29/10/2025.

The Court was informed that the matter is “presently under active consideration of the CBDT,” and that “in all probability, the requisite notification/order is expected to be issued by tomorrow.”

Earlier in the day, the Bench had strongly reprimanded the CBDT counsel for failing to comply with the Gujarat High Court’s order, which had directed the extension of the ITR filing deadline in view of ongoing technical and compliance difficulties faced by taxpayers and professionals.

The Court had initially warned that failure to notify the extension would amount to clear contempt of the Gujarat High Court’s directions, adjourning the matter till 1:45 PM and directing the counsel to produce the extension order.

Following the afternoon hearing, it was recorded on the court’s order that the Department has assured the Court of a resolution by tomorrow, signaling a positive outcome for taxpayers and professionals awaiting relief.

According to CA Gaurav Gupta, President of the Income Tax Practitioners Association (ITPA), Amritsar, “the Hon’ble Punjab & Haryana High Court has recorded the statement of CBDT’s counsel that the necessary extension orders are likely to be passed by tomorrow. The matter is actively under CBDT’s consideration, and the notification is expected soon.”

Tax professionals across the country are now awaiting the official notification from the CBDT, which, if issued tomorrow, will formally extend the due date for filing Income Tax Returns for the Assessment Year 2025–26.

This development comes as a major relief amid growing demands for an extension due to technical glitches, audit season workload, and compliance challenges.
