The Delhi High Court has expressed the Concern over pending appeals before National Faceless Appeal Centre (NFAC) and urges expedited disposal.
The bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela said, “This court is cognizant of the large number of statutory appeals pending for disposal before the NFAC and express concern over the delay in disposal of such appeals, for which the NFAC was envisaged. We expect that the NFAC would endeavour to implement the said remedial measures in all earnest.”
The bench noted that some concern that the appeal filed on 14.10.2022, is still pending adjudication for more than 2 years before the CIT(A).
The petitioner/assessee has filed a writ petition seeking a direction to NFAC to decide their appeal, which has been pending for over two years since October 14, 2022, within a timeframe of 4 to 8 weeks.
The petitioners requested the issuance of guidelines to ensure timely disposal of pending appeals and to prevent unnecessary harassment of taxpayers.
The petitioner sought interest and compensatory costs for the significant delay in deciding the appeal, along with the costs of the petition.
The NFAC handed over a roadmap to dispose of pending appeals to the tune of 5,49,042 appeals, in a time bound manner as per the Central Action Plan 2024-25.
The court directed that the appeal filed on 14.10.2022 under e- filing acknowledgment be taken up for consideration and disposed of with expedition not beyond a period of eight weeks.
