Delhi High Court Directs Customs To Release Gold Kada Worn By A Sikh Man

The Delhi High Court has directed the customs to release Gold Kada worn by a Sikh man as the Gold Kada is merely a personal effect of the Petitioner.

The bench of Justice Prathiba M. Singh and Justice Rajneesh Kumar Gupta has observed that the gold kada seized is merely a personal effect of the Petitioner, in the opinion of this Court, the detention itself would be contrary to law.

The petitioner, Dalvinder Singh Sudan was travelling from Dubai as a tourist and arrived at the Indira Gandhi International Airport. During the travel, the Petitioner was stated to be wearing a 22 carat gold kada weighing 60 grams. 

The Petitioner stated that the kada was used as a personal effect of the Petitioner. It is also submitted that the Petitioner being a Sikh, always wears this kada. The Petitioner has placed photographs on record as well.

The detention of the gold kada took place and a Show Cause Notice was issued. The SCN also records the fact that the Petitioner did not want the SCN and personal hearing and that the case may be decided on merits. 

The court held that the petitioner shall be entitled to release of the gold kada within a period of four weeks subject to payment of warehouse charges.
