The Patna High Court took up a writ petition filed by Advocate Saroj Kumar concerning issues surrounding the upcoming Advocates’ Association elections, particularly the participation of women and the fixation of nomination fee.
The matter was heard by Justice Ajit Kumar in a civil writ jurisdiction case filed by advocate Saroj Kumar. The petition raised concerns over certain aspects of the election process, including adherence to guidelines and the rationale behind nomination charges for candidates contesting various posts.
During the hearing, the Court sought clarification from the Chairman of the Bihar State Bar Council and the Returning Officer of the Advocates’ Association elections. Senior counsel appearing for the respondents informed the Court that any decision regarding women’s participation would be taken strictly in line with the directions issued by the Supreme Court of India.
On the issue of nomination fees, the respondents submitted that they would place on record the reasoning and justification for the fee structure. They assured the Court that the fixation would be supported by a “reasonable nexus” along with relevant materials explaining the basis of such charges.
The Court also observed that if required, consultations may be held with the current office bearers of the Advocates’ Association to arrive at an amicable resolution on the fee issue. It emphasized that such deliberations should be properly documented and presented before the Court for consideration.
Taking note of the time-sensitive nature of the election process, the Court listed the matter for further hearing on March 26, 2026, at 10:30 AM.
