The Rajasthan High Court has taken serious note of repeated non-compliance by the State’s Medical & Health Department in failing to place an inspection report on record in a writ petition filed by M.R. College of Physiotherapy. Observing that the conduct of the department reflects “absolute disregard and disrespect” towards judicial orders, the Court has directed the Principal Secretary, Medical & Health Department, to appear personally and file an affidavit explaining the delay.
The bench of Justice Sanjeet Purohit has observed that in several other matters where similar directions had been issued to produce inspection reports of institutions, the department had failed to comply. This, the Court said, indicated “flaws, non-transparency, and lack of accountability” within the department.
Mrs. Shaambhavi Bhansali Mardia, Counsel for the petitioner submitted that despite multiple directions from the Court, the respondents had failed to place the inspection report of the college on record. The Court noted that as early as November 26, 2024, the Additional Advocate General was directed to produce the inspection report.
After nearly a year, on November 20, 2025, the Court reiterated its direction and listed the matter for compliance. Even when the case was taken up again on December 6, 2025, there was no compliance. Though a “last opportunity” was granted in the interest of justice, the department again failed to act.
On the latest hearing dated February 18, 2026, the State sought further time, stating that several communications had been sent to the concerned authorities. However, the Court found this explanation unsatisfactory.
In strong remarks, the Court observed that the conduct of the respondent department “clearly amounts to willful and deliberate non-compliance” with judicial orders. It further noted that this was not an isolated instance.
Taking serious note of the situation, the Court directed the Principal Secretary, Medical & Health Department, to remain present before the Court on February 25, 2026, at 2:00 p.m., either personally or via video conferencing.
The officer has been directed to file a personal affidavit on or before the said date, explaining the reasons for the delay in complying with the Court’s orders dated November 26, 2024, and November 20, 2025. The reasons for not granting the No Objection Certificate (NOC) to the petitioner-college in a timely manner.
