SC Cautions Against Misuse of Criminal Law in Civil Disputes, Says Courts Cannot Be ‘Recovery Agents’

The Supreme Court issued a stern caution against the growing misuse of criminal law to settle civil disputes, stressing that courts cannot be turned into “recovery agents” for private parties seeking to enforce monetary claims.

A bench comprising Justice Surya Kant and Justice N Kotiswar Singh observed that an alarming trend has emerged where parties resort to filing criminal complaints in matters that are purely civil in nature, particularly for money recovery. The judges categorically disapproved of using the threat of arrest as a pressure tactic in such disputes.

“The practice of converting civil disagreements into criminal cases must be checked. Criminal proceedings are meant for genuine offences, not for enforcing personal financial obligations,” the bench remarked.

The observations came while hearing a case from Uttar Pradesh in which an individual, accused of defaulting on a money repayment, was charged with kidnapping. Highlighting the misuse, the Court clarified that criminal charges cannot be weaponized to settle personal scores or bypass civil remedies.

During the hearing, Additional Solicitor General KM Natraj, appearing for the Uttar Pradesh government, argued that in some situations, initiating criminal proceedings becomes inevitable when financial obligations are ignored and civil remedies prove ineffective.

Acknowledging the challenges faced by law enforcement, the Court noted the dilemma of police officials who are criticized if they refuse to register FIRs even in doubtful cases. To address this, the bench urged police officers to exercise discretion and apply their mind before lodging FIRs.

Further, the Court suggested that states should consider appointing nodal officers — preferably retired judges — to assist the police in assessing whether a case falls within the civil or criminal domain.

By reiterating that criminal law cannot be misapplied as a tool for financial recovery, the Supreme Court has once again underlined the importance of preserving the integrity of both civil and criminal justice systems.
