Supreme Court Restrains CBI, ED From Filing Report in Rahul Gandhi Assets Case; Allahabad HC Proceedings Deferred

The Supreme Court on August 17, 2026, directed the Central Bureau of Investigation (CBI), Enforcement Directorate (ED) and any other investigating authority not to submit a report before the Allahabad High Court in connection with allegations of disproportionate assets against Congress leader and Leader of Opposition in the Lok Sabha, Rahul Gandhi.

The direction came while the Supreme Court was hearing Rahul Gandhi’s challenge to a July 20 order of the Lucknow Bench of the Allahabad High Court, which had directed the CBI and ED to examine allegations relating to his alleged disproportionate assets.

Supreme Court Questions Agencies’ Inaction

A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohana questioned why the central agencies required directions from the High Court to examine allegations that were being described as serious.

During the hearing, the CBI told the Supreme Court that it had not registered even a preliminary enquiry and was only verifying the complaint. Additional Solicitor General S. V. Raju, appearing for the CBI, submitted that the allegations were serious and that the agency was examining them.

Justice Joymalya Bagchi questioned the need for the High Court’s intervention if the allegations were sufficiently serious to warrant investigation, observing that the agencies could have acted on their own initiative.

Rahul Gandhi Challenges High Court Procedure

Senior Advocate Kapil Sibal, appearing for Rahul Gandhi, challenged the manner in which the Allahabad High Court had proceeded. He argued that the High Court had passed the July 20 order without first obtaining Rahul Gandhi’s response and had not adequately examined the standing of the petitioner.

Sibal also questioned the continuation of what he described as proceedings directed against Gandhi without giving him an opportunity to respond.

The petition before the Supreme Court was filed against the Allahabad High Court’s directions arising from a complaint concerning alleged disproportionate assets.

No FIR Registered So Far, CBI Tells SC

The CBI clarified before the Supreme Court that no FIR had been registered in the matter at this stage. The agency maintained that it was still examining the allegations and that any decision regarding further action had not yet been taken.

The Supreme Court noted that investigative agencies can proceed where there is prima facie material indicating a cognisable offence. However, the Chief Justice observed that when a court itself directs such action, the court is expected to follow the principles of natural justice.

SC Issues Notices to Authorities

The Supreme Court issued notices to the complainant S. Vignesh Shishir, besides the CBI, ED, Uttar Pradesh Police, Ministry of Home Affairs, Central Board of Direct Taxes (CBDT) and Serious Fraud Investigation Office (SFIO).

Pending further consideration of the matter, the Court specifically directed that no report should be submitted before the Allahabad High Court by the CBI, ED or any other authority pursuant to the High Court’s July 20 order.

Allahabad HC Hearing Put on Hold

The Supreme Court also asked the Allahabad High Court to defer its scheduled August 20 hearing in the matter until further orders.

The direction effectively puts the proceedings before the High Court on hold while the Supreme Court considers Rahul Gandhi’s challenge to the High Court’s order. The Supreme Court has not, at this stage, finally determined the allegations concerning Gandhi’s assets.

What Happens Next?

The Supreme Court has issued notices to the concerned parties and authorities, meaning the underlying legal dispute remains pending. The restraint on filing investigative reports is an interim direction and should not be construed as a final judicial finding on the allegations.

The case will now be considered by the Supreme Court, while proceedings before the Allahabad High Court remain deferred for the time being.

The Supreme Court has not adjudicated whether the allegations against Rahul Gandhi are true or false. Its immediate intervention concerns the manner in which the proceedings were initiated and the directions issued to the investigating agencies. The CBI has also clarified that no FIR has been registered so far.
