The Supreme Court has held that registration of document recording purchase of immovable property doesn’t confer guaranteed title of ownership. The Justice P.S. Narasimha and Justice Joymalya Bagchi observed that the registration of a document recording purchase of immovable property does not confer guaranteed title of ownership, instead it only serves as a public record of the transaction having presumptive evidentiary value, but it is never a conclusive proof of ownership. The bench observed thus in Civil Appeals arising out of the Judgment of the Patna High Court, which dismissed a Writ Petition challenging the vires of sub-rules (xvii) and (xviii) of Rule 19 of the Bihar Registration Rules, 2008, introduced through the 2019 amendment to the Rules. The Bench explained, “Rather strangely these legislations have long sustained dichotomy between ownership and registration. While Transfer of Property Act provides substantive legal framework for purchase and sale of immovable property and the Stamp Act imposes a fiscal charge on the transferable property as a precondition for registration, the Registration Act institutionalizes the process of registering documents to create a public record of immovable property transactions. The Registration Act mandates registration of documents, not the title and this distinction is the fundamental character of our country’s presumptive titling system through registration. Thus, registration of a document recording purchase of immovable property does not confer guaranteed title of ownership, instead it only serves as a public record of the transaction having presumptive evidentiary value, but it is never a conclusive proof of ownership.” The Bench was of the opinion that following good governance through modern legislation, it is necessary to fully institutionalize the registration offices by establishing a permanent regulatory body, which will enable real time assessment and development of the establishment through institutional efficiency and expertise. “A permanent body will enable institutional memory for upgradation and improvement. It will also enable course correction and modernization”, it added. Mutation Cannot Be a Precondition for Registration, Says Court The struck-down provisions empowered Sub-Registrars to refuse registration of sale/gift documents if Jamabandi (for rural land) or holding allotment (for urban flats/apartments) in favour of the seller was not recorded or proved. The Court held that such a requirement was legally unsustainable because: The Registration Act mandates registration of documents, not titles. Mutation does not create or confer title and cannot be used as a mandatory proof of ownership. Registering officers have limited powers—to verify identity of parties, verify execution, and identify the property—not to adjudicate title disputes. The Bench noted that the new rules "tilted the balance" by forcing the registering authority to demand collateral proof of title—a requirement foreign to the Registration Act. State’s Mutation System “Nowhere Near Implementation” The Supreme Court criticised the State’s justification that the rule was needed to align registration with actual landholdings. Citing ground realities, the Court observed: 80% of Jamabandis are still in the names of ancestors, not current owners. 95–98% of recorded Jamabandi holders are deceased, often 2–3 generations old. Bihar’s Special Survey and Settlement Act, 2011, acknowledges that tenancy registers and mutation records have not been properly updated for decades. The ongoing survey and digitisation efforts are incomplete, making compliance “virtually impossible”. Under these circumstances, conditioning registration on mutation certificates would effectively freeze property transactions in Bihar, the Court warned. Violation of Citizens’ Right to Dispose of Property The Court reaffirmed that the constitutional right to own property includes the right to freely transfer it. Any rule that impedes this right without clear statutory backing is unconstitutional. The judgment notes: “A requirement that restrains easy and effective transfer of property is illegal, as it directly deprives citizens of their right to hold and dispose of property.” The rule, therefore, was held to be arbitrary, unreasonable, and beyond the State’s delegated legislative power. In a significant aside, the Court used this case to highlight longstanding flaws in India’s real-estate legal framework, still based on century-old colonial statutes. It stressed the persistent dichotomy between registration of documents and conclusive proof of title, which has burdened buyers and resulted in: Massive title uncertainty Lengthy title searches Public reliance on presumptive, non-conclusive records Property disputes constituting over 66% of civil litigation The Court discussed emerging technological solutions such as Blockchain-based title records, calling them a possible pathway towards secure, tamper-proof, conclusive land titling. Direction to Law Commission: Examine Integration of Registration With Title Underscoring the need for systemic overhaul, the Supreme Court requested the Law Commission of India to consult the Union and States on overhauling property registration, explore technology-driven reforms, examine restructuring of several laws, including the Transfer of Property Act, Registration Act, Stamp Act, IT Act, and the Data Protection Act, and consider mechanisms for conclusive titling and secure digital land records.
