Fraudulent Domain Names Using Well-Known Trademarks: Delhi HC Issues Directions

The Delhi High Court has issued the directions for the Registrars, Banks and Government in pertaining to fraudulent domain names using well-known trademarks for fake dealerships, online scams. The bench of Justice Prathiba M. Singh has described domain names as the “online soul” of a business and observed that fraudulent registrations using established brand names have become a systemic menace, causing massive financial losses to innocent consumers and serious erosion of brand goodwill. The case arose from a growing pattern of fraudulent domain name registrations exploiting well-known trademarks to deceive the public, particularly through fake websites posing as authorised representatives of established brands. Over the years, several trademark owners approached the court after discovering that unknown persons had registered domain names closely resembling their official brand names and trademarks and were using those websites for unlawful commercial activities. These impugned websites typically mimicked the look and feel of the genuine brand portals by using identical or deceptively similar trademarks, logos, product images, and promotional content. Members of the public were misled into believing that the websites were official or authorised platforms of the brand owners. Under this false impression, victims were induced to apply for dealerships, distributorships, franchises, or employment opportunities, and were asked to deposit money into specified bank accounts. A key challenge highlighted in the background of the case was that the identity of the persons operating these websites remained largely untraceable. Domain names were registered using fictitious or incomplete details, temporary email addresses, masked mobile numbers, and privacy protection services offered by domain name registrars. Even when WHOIS data was accessed, it often revealed misleading or unverifiable information, making it extremely difficult for trademark owners and law enforcement agencies to identify the actual perpetrators. The problem was further aggravated by the speed and scale at which such frauds were being committed. Bank accounts used for collecting money were typically operational only for a short period. Funds were quickly withdrawn, and before any effective legal action could be taken, the operators would abandon the domain and resurface with a new infringing website using a similar modus operandi. Given the repetitive nature of these frauds, multiple trademark owners filed suits seeking injunctions not only against the infringing domain names but also against domain name registrars, internet service providers, government authorities, banks, and other intermediaries. The objective was to secure effective and enforceable relief, prevent recurrence of similar frauds, and address the systemic loopholes enabling misuse of trademarks in the digital ecosystem. The present matter was heard as part of a larger batch of cases raising common issues relating to trademark infringement, passing off, cyber fraud, intermediary liability, and enforcement of court orders in the context of domain names, prompting a detailed examination of the existing framework governing domain name registration and online enforcement mechanisms. The court noted that misuse of trademarks through domain names has become a recurring and organised modus operandi, where fraudsters deliberately register domains incorporating well-known brands to lend false legitimacy to their activities. Domain names today form the digital identity of a business, and misuse of a brand name as a domain directly impacts the goodwill, reputation and consumer trust associated with that brand. The Court observed that fraudulent websites are designed to closely imitate official brand portals, using similar layouts, logos, product images and content, making it difficult for ordinary consumers to distinguish genuine websites from fake ones. Privacy protection and proxy services offered during domain registration are frequently abused, resulting in registrant details that are fictitious, incomplete or untraceable, thereby shielding fraudsters from accountability. The Court noted that mere disclosure of email IDs or masked contact details is ineffective, as such information rarely leads to identification of the real individuals behind the fraud. It was observed that bank accounts used in these frauds are often short-lived, with funds being withdrawn swiftly before enforcement agencies or brand owners can intervene. The Court highlighted that trademark owners are forced to engage in repeated litigation, as fraudsters abandon blocked domains and immediately create new infringing websites using similar naming patterns. The existing system places an unreasonable burden on trademark owners to constantly monitor and challenge infringing domain names, despite the large-scale and automated nature of such frauds. The Court emphasized that intermediaries cannot remain passive spectators when their services are repeatedly used to facilitate deception and financial fraud. The Court observed that consumer protection is as critical as trademark protection, since innocent members of the public suffer significant financial losses due to these deceptive practices.
