Amid growing misinformation and speculation regarding the incident at the residence of Justice Yashwant Varma, the Supreme Court’s In-house enquiry procedure has been duly initiated.
The Chief Justice of the Delhi High Court has submitted his report to the Chief Justice of India (CJI) today, following a comprehensive examination of evidence and information.
Supreme Court’s In-House Enquiry Framework
The In-house enquiry mechanism, established through the Supreme Court’s judgment in C. Ravichandran Iyer v. Justice A.M. Bhattacharjee (1995) 5 SCC 457, serves as the guiding framework for such investigations. The procedure was further elaborated in Additional District and Sessions Judge ‘X’ v. Registrar General, High Court of Madhya Pradesh(2015) 4 SCC 91, ensuring a structured and impartial process.
Upon receiving relevant information, the Chief Justice of the Delhi High Court promptly initiated the In-house enquiry, gathering necessary evidence. This process was already underway before the Supreme Court Collegium convened on March 20, 2025. The report, now with the CJI, will undergo review for further necessary action.
Justice Yashwant Varma’s Transfer Proposal
In a separate and independent development, the Supreme Court Collegium deliberated on the transfer of Justice Yashwant Varma. Currently serving as the second senior-most judge of the Delhi High Court and a member of its Collegium, Justice Varma has been proposed for transfer to his parent High Court in Allahabad, where he would be ninth in seniority.
The transfer proposal was examined on March 20, 2025, by the Collegium, consisting of the CJI and the four senior-most judges of the Supreme Court. Letters seeking opinions were subsequently sent to consultee judges of the Supreme Court, the Chief Justices of the concerned High Courts, and Justice Varma himself. Upon receipt and examination of responses, the Collegium will finalize its resolution.
Addressing Misinformation
Recent speculation surrounding the incident at Justice Varma’s residence has led to widespread misinformation. Legal experts emphasize that the In-house enquiry is being conducted per established judicial procedures, ensuring due process. Furthermore, the proposed transfer is an independent administrative decision and should not be conflated with the enquiry.
