24 Hour Period To Produce Before Nearest Magistrate Doesn’t Start From Temporary Restraint During Search And Seizure: Orissa High Court

The Orissa High Court has held that a 24 hour period to produce before the nearest magistrate does not start from temporary restraint during search and seizure. The bench of Justice R.K. Pattanaik has dismissed a criminal revision petition challenging the legality of detention under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act), holding that temporary restraint during search and seizure does not amount to arrest, and therefore does not trigger the 24-hour constitutional mandate for production before a Magistrate. The bench ruled that the petitioner’s production before the Special Court was within the permissible 24-hour period, even if detention is assumed from the time he was taken away by the Narcotics Control Bureau (NCB) after completion of search proceedings The petitioner was apprehended by the NCB on 22 July 2025 following a search at his Bhubaneswar residence based on prior intelligence from the Delhi Zonal Unit. The search commenced at 1:15 PM and concluded at approximately 4:50 PM, during which the NCB allegedly recovered a commercial quantity of LSD. Although a formal arrest memo recorded the arrest at 11:30 PM, the petitioner was produced before the Special NDPS Court on 23 July 2025 between 5:00 PM and 5:30 PM. He remained in judicial custody thereafter. The petitioner challenged his continued detention, arguing that he had been effectively arrested from 1:15 PM, when the NCB entered his residence and restrained his movement, and that his production beyond 24 hours violated Article 22(2) of the Constitution and Section 57 of the CrPC (now Section 58 BNSS) The petitioner contended that arrest is not confined to the time recorded in official documents but begins when a person is physically restrained and deprived of liberty. The petitioner was under complete control of NCB officials from 1:15 PM and was not free to leave his residence. The delayed formal arrest was a procedural device to defeat constitutional safeguards. Detention for nearly 28 hours before production rendered the arrest illegal and entitled the petitioner to immediate release. The department argued that the petitioner was not arrested during the search, but only detained temporarily for investigation. Formal arrest occurred at 11:30 PM, after completion of seizure, documentation, and interrogation under Section 67 of the NDPS Act. Production before the court on the following day was well within 24 hours of arrest. Treating every search-related restraint as arrest would make lawful investigations impracticable. The procedural and evidentiary issues could be raised during bail proceedings, which were already pending before the High Court The Court undertook an extensive examination of the distinction between “detention” and “arrest”, emphasizing that the detention during search and inquiry is investigatory, whereas arrest is accusatory and based on a reasonable belief of guilt. Presence of a suspect during search is mandatory and does not, by itself, amount to arrest. The constitutional clock under Article 22(2) begins only when detention transforms into arrest, i.e., when liberty is curtailed on the basis of probable cause. The court held that the petitioner could not be deemed arrested at 1:15 PM, when the search began. Even assuming arrest from 4:50–5:00 PM, when he was taken to the NCB office after completion of seizure, his production on the next day around 5:00 PM was within 24 hours. Delay in recording formal arrest, though undesirable, did not render the detention unconstitutional in the present facts. The Court clarified that the ruling in Subhash Sharma was fact-specific, as it involved prolonged detention through a Look-Out Circular without timely production before court, which was not the case here The High Court concluded that there was no violation of Article 22(2) or Section 57 CrPC / Section 58 BNSS. The Special Judge’s order dated 12 September 2025 suffered from no legal infirmity. The revision petition was dismissed, leaving the petitioner at liberty to pursue his bail application on other grounds.
