The Government of NCT of Delhi has issued a crucial clarification regarding building construction in the city. In a circular released by the Urban Development Department, the government has made it clear that no police permission is required for carrying out construction activities.
The circular, signed by Additional Chief Secretary (UD) Navin Kumar Choudhary, emphasizes that building construction is regulated by the Municipal Corporation of Delhi (MCD) and other local bodies, as per the Delhi Municipal Corporation (DMC) Act, 1957. There is no legal provision under the Delhi Municipal Corporation (DMC) Act, 1957 that mandates obtaining police approval for construction.
Clarification on the Role of Police
While police authorities do not have a role in granting construction approvals, the circular acknowledges that certain sections of the DMC Act, 1957 (Sections 474, 475, and 466) allow police to report violations of the law or investigate offenses related to illegal construction. However, the government has warned against the misuse of these provisions for rent-seeking.
“It has come to notice that some individuals misinterpret these laws, leading to unlawful demands for police permission. This misconception must be addressed,” the circular states.
Delhi Police Instructed to Prevent Misuse
To curb such malpractices, the Delhi Police has been directed to sensitize field officers and ensure that no unnecessary permissions are sought from them. However, the police will continue to assist municipal authorities in legal enforcement and action against violations.
