DGFT Amends in Foreign Trade Procedures to Facilitate Ease of Doing Business

The Directorate General of Foreign Trade (DGFT) announced important amendments in Para 4.53 of the Handbook of Procedures (HBP), 2023  i.e. Foreign Trade Procedures to Facilitate ease of doing business by allowing importers to correct unit of measurement, correct itc hs code of import item and correct value of import item.

The amendments are designed to enhance the correction mechanism for errors related to unutilized and un-transferred DFIA (Duty Free Import Authorization) licenses, particularly focusing on system-related and corrective changes. The new provision introduces a facility for applicants to file amendments in ANF 4G form directly through the DGFT’s online system, subject to the approval of the Head of Office.

According to the Public Notice, an additional sub-paragraph – Para 4.53 (e) – has been incorporated into the Handbook of Procedures, 2023, which now reads as follows:

“An application for such amendments in unutilized and un-transferred DFIAs, which are system-related and corrective in nature, shall be filed in ANF 4G. Any such amendment would require approval of Head of Office.”

To provide clarity on the practical application of the new provision, the Public Notice outlines illustrative examples where corrections will now be permissible:

Correction in Unit of Measurement: Importers can now correct discrepancies in the unit of measurement associated with their DFIA entries.

Correction in ITC HS Code of Import Item: Amendments to rectify errors in the ITC Harmonized System (HS) codes of import items can now be easily filed.

Correction in Value of Import Item: Adjustments related to the declared value of import items are allowed to ensure accurate documentation.
