Worn Luxury Watch Is a ‘Personal Effect’ Under Baggage Rules: Delhi HC Orders Release of Seized Rolex Watch

The Delhi High Court has ordered the release of a Rolex watch seized by the Customs Department at the Indira Gandhi International Airport, holding that a worn luxury watch carried by a passenger qualifies as a “personal effect” under the Baggage Rules, 2016 and is not liable to detention or seizure. The Bench Of Justice Prathiba M. Singh and Justice Shail Jain while disposing of a writ petition filed by Ranvir Sra, a Canadian citizen and Overseas Citizen of India (OCI) cardholder, observed that jewellery that is bona fide in personal use by the tourist would not be excluded from the ambit of personal effects as defined under the Baggage Rules. Further, the Department is required to make a distinction between ‘jewellery’ and ‘personal jewellery’ while considering seizure of items for being in violation of the Baggage Rules.” The petitioner had approached the High Court challenging the detention of his Rolex watch, which was seized by Customs officials on 30 November 2024 upon his arrival in India. According to the petitioner, the Rolex watch was part of his personal belongings and had been purchased in Canada on 2 October 2023. He placed on record photographs and the original invoice to establish that the watch was not a newly imported item but a worn personal accessory. Despite the passage of nearly a year since the detention, no show cause notice had been issued by the Customs Department. During earlier proceedings, the High Court directed Customs authorities to produce the watch before the court. When presented in a sealed box, the Bench noted that the watch was clearly worn and not new. The Customs Department also confirmed that the serial number of the watch matched the invoice produced by the petitioner. The High Court observed that the legal issue involved was no longer res integra. Relying on a series of judgments of the Supreme Court and the Delhi High Court, the Bench reiterated that personal jewellery and accessories worn by a passenger cannot be automatically excluded from the ambit of “personal effects” under the Baggage Rules. The court referred to the Supreme Court’s decision in Directorate of Revenue Intelligence v. Pushpa Lekhumal Tolani, which held that even jewellery of substantial value may qualify as a personal effect if it is bona fide for personal use, irrespective of whether it is new or used. The apex court had clarified that customs authorities are not expected to verify the “newness” of every personal item carried by a traveller. The Bench also relied on the Delhi High Court’s Division Bench ruling in Saba Simran v. Union of India, where a clear distinction was drawn between “jewellery” as a dutiable item and “personal jewellery” used and worn by a passenger. That judgment, which was later upheld by the Supreme Court, affirmed that used personal jewellery does not attract seizure merely because of its value. Further reference was made to the Delhi High Court’s decision in Makhinder Chopra v. Commissioner of Customs, where it was held that bona fide personal jewellery in use by a tourist falls within the definition of personal effects and that customs authorities must distinguish between commercial imports and personal accessories. The court concluded that the Rolex watch worn by the petitioner clearly fell within the category of “personal effects” under the Baggage Rules, 2016. As such, its detention by the Customs Department was held to be unsustainable in law. The Court set aside the detention and directed the immediate release of the Rolex watch to the petitioner. It also waived any warehousing charges that may have accrued during the period of detention. The court directed the petitioner to appear before the Customs Department on 24 December 2025, either in person or through an authorised representative, with virtual participation for identity verification. A nodal customs officer was designated to facilitate compliance with the court’s order.
