CESTAT Allows Service Tax Refund on Head Office Services Used for Exports

The Chennai Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has ruled that service tax paid on input services used at a company’s head office or corporate office for export of goods is eligible for refund under Notification No. 41/2012-ST, as retrospectively amended by Notification No. 1/2016-ST. The bench of P. Dinesha (Judicial Member) and Vasa Seshagiri Rao (Technical Member) held that the Department’s restrictive interpretation excluding head office services was legally unsustainable and remanded the matter for limited verification of documents and export nexus. The case involved M/s. eShakti.com Pvt. Ltd., Chennai, a manufacturer and exporter of ready-made garments. The company had filed five refund claims for service tax paid on various input services used in connection with exports during the period from January 2014 to March 2015. Owing to a clerical mistake, the claims were initially filed under Notification No. 27/2012-CE instead of Notification No. 41/2012-ST. The refund claims were initially rejected by the original adjudicating authority and the Commissioner (Appeals). In an earlier round of litigation, CESTAT remanded the matter in 2023 for fresh consideration under Notification No. 41/2012-ST. Upon remand, the Assistant Commissioner partly sanctioned the refunds and rejected the balance. However, the Commissioner (Appeals), acting on appeals filed by the Revenue, set aside even the sanctioned portion and upheld the rejections, prompting the exporter to approach the Tribunal again. The Department rejected the refund claims primarily on two grounds. First, several services such as renting of immovable property, courier, security, telephony, professional and IT services, repair and maintenance, and clearing and forwarding services were held to be not used “beyond the place of removal” and therefore not qualifying as “specified services” under Notification No. 41/2012-ST. Second, certain portions of the claims were rejected as time-barred or on the ground that the invoices pertained to different quarters than the one for which the refund was claimed. The Tribunal examined the scope of Notification No. 41/2012-ST in light of Notification No. 1/2016-ST, which retrospectively amended the definition of “specified services” with effect from 1 July 2012. After the amendment, specified services were defined as taxable services used beyond the factory or any other place or premises of production or manufacture for export of goods. The Tribunal held that the amendment was clarificatory and applicable to the disputed period. Rejecting the Department’s reliance on the pre-amendment phrase “beyond the place of removal,” the Tribunal held that services used at the head office or corporate office for export-related activities are squarely covered by the amended definition. It observed that the head office performed essential export functions such as order processing, coordination with foreign buyers, export documentation, logistics management, and regulatory compliance, making the services used therein integral to the export process. The Tribunal also relied on earlier precedent to hold that there is no legal basis for segregating services into pre-export and post-export categories. What is relevant is whether the services were used beyond the place of manufacture and had a nexus with exports. Applying this principle, the Tribunal ruled that head office services such as renting, telecommunication, security, professional consultancy, IT support, repair and maintenance, and clearing and forwarding services qualify as specified services for refund purposes. The Tribunal clarified that Notification No. 41/2012-ST prescribes only a one-year time limit from the date of export for filing refund claims and does not impose any quarter-wise filing restriction. It held that importing procedural conditions from Notification No. 27/2012-CE was erroneous. Accordingly, invoices could not be rejected merely because they related to a different quarter, provided the claim was filed within one year from the date of export and the export nexus was established. While deciding the legal issues in favour of the exporter, the Tribunal noted that detailed invoice-wise verification of authenticity, nexus with exports, and compliance with the one-year limitation had not been carried out by the authorities. It therefore ordered a limited remand to the lower adjudicating or refund sanctioning authority for verification of documents. The Tribunal directed that fresh orders be passed within 90 days after following the principles of natural justice. It further held that any refund found admissible upon verification must be sanctioned in accordance with law and disbursed with applicable interest. Case Details Case Title: M/s. eShakti.com Pvt.
