Refund Claim Time-Barred Despite Duty Reduction: CESTAT Rules Limitation Runs from First Appellate Order

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Chennai Bench has held that a refund claim arising from an appellate relief must be filed within one year from the date of the first appellate order, and not from subsequent proceedings. The bench of P. Dinesha (Judicial Member) and Vasa Seshagiri Rao (Technical Member) has observed that the statutory framework under Section 11B clearly provides that where refund arises as a consequence of an appellate order, the “relevant date” for filing refund is the date of such order. In the present case, the Commissioner (Appeals) had passed the order granting relief on 25.01.2012. Therefore, the limitation period of one year had to be computed from that date. The dispute arose after the appellant, a manufacturer of safety matches, was subjected to investigation by DGCEI on allegations of suppression of production and clandestine removal. During the course of investigation, the assessee made certain payments even before issuance of the show cause notice. Eventually, adjudication culminated in confirmation of duty demand along with interest and penalty. However, on appeal, the Commissioner (Appeals) substantially reduced the duty demand, resulting in excess payment by the assessee. Following this relief, the assessee filed a refund claim in October 2016. However, the Department rejected the claim on the ground that it was filed beyond the statutory limitation period of one year prescribed under Section 11B. This rejection was upheld by the Commissioner (Appeals), leading to the present appeal before the Tribunal. Before the Tribunal, the appellant argued that the amounts paid during investigation were in the nature of deposits made under protest and therefore, the limitation prescribed under Section 11B would not apply. It was contended that such payments do not assume the character of “duty” until adjudication is completed, and hence the relevant date for computing limitation should be the date of final resolution of the dispute. The Tribunal, however, drew a clear distinction between payments made during investigation and their subsequent appropriation. It observed that although payments made prior to adjudication may initially be treated as deposits, once such amounts are appropriated against confirmed demand in the adjudication order, they assume the character of “duty.” Therefore, any refund arising thereafter would be governed strictly by Section 11B. Rejecting the appellant’s contention that limitation should run from the date when the Department’s appeal was dismissed by the Tribunal, the Bench clarified that pendency of further appeal does not extend or defer the statutory limitation unless specifically provided in law. The Tribunal noted that once an assessee obtains a favourable appellate order giving rise to a refund, the right to claim such refund accrues immediately, and the assessee is expected to act within the prescribed time. The Tribunal also addressed the argument regarding cross-objections filed by the assessee in the Department’s appeal. It held that such cross-objections are merely defensive in nature and do not constitute an independent cause of action capable of extending limitation. Since no fresh adjudication or relief was granted by the Tribunal while dismissing the Department’s appeal, the relevant date could not be shifted to the Tribunal’s order. Further, the Tribunal clarified that even amounts towards penalty, once appropriated through adjudication, would fall within the ambit of Section 11B for the purpose of refund, and limitation provisions would apply equally. In conclusion, the Tribunal held that the refund claim filed in October 2016, nearly four years after the favourable Order-in-Appeal, was clearly beyond the permissible period of one year. Accordingly, it upheld the rejection of refund and dismissed the appeal. Case Details Case Title: M/s.
