No Penalty Against Customs Broker In A Poppy Seeds Smuggling Case Without Clear Findings: Calcutta HC

The Calcutta High Court has set aside penalties imposed on a Customs Broker in a case involving alleged smuggling of poppy seeds concealed in a transshipment consignment, holding that penalties under the Customs Act cannot be sustained without clear findings of knowledge, intention, or abetment. The bench of Justice Om Narayan Rai observed that the adjudicating authority failed to provide adequate reasoning or establish the essential ingredients required to impose penalties under Sections 112(a), 112(b), and 114AA of the Customs Act, 1962. The petitioner, Bikash Bose, was a partner in a shipping agency acting as a Customs Broker. He had been engaged to handle documentation for a Bhutan-bound transshipment consignment declared as detergent powder imported from Malaysia. During examination of the container in June 2024, authorities discovered that, in addition to detergent powder, the cargo also contained large quantities of poppy seeds, which are subject to strict import restrictions. Following investigation, the Directorate of Revenue Intelligence issued a show cause notice alleging that the broker had abetted smuggling, knowingly handled forged documents, and attempted to facilitate clearance of misdeclared goods. An adjudication order dated July 1, 2025 imposed penalties under multiple provisions of the Customs Act, prompting the petitioner to approach the High Court. The petitioner contended that the adjudication order was largely a reproduction of the show cause notice and lacked independent reasoning. There was no evidence establishing that he knew about the misdeclaration of goods. As a Customs Broker, he relied on documents supplied by the importer and had no access to the sealed container. Payment of shipping and related charges was part of routine industry practice and could not be treated as incriminating conduct. He also argued that penalties had been imposed mechanically and disproportionately, even exceeding those imposed on the importer. The Customs Department opposed the petition, arguing that the broker had actively pursued clearance of the container and paid charges independently. Statements recorded during investigation suggested he had knowledge of the consignment’s contents. His actions amounted to abetment of smuggling and submission of false documents, making penalties legally justified.The authorities also contended that the writ petition should not be entertained because an alternative appellate remedy was available. The High Court held that the existence of an alternative remedy does not bar writ jurisdiction where there is a breach of natural justice or failure to apply the law correctly. The Court observed that while the adjudicating authority reproduced allegations and submissions, it failed to provide a reasoned basis for rejecting the petitioner’s explanation or establishing culpability. The Court emphasized that penalties under Sections 112(a), 112(b), and 114AA require clear evidence of knowledge, intention, or deliberate involvement in misdeclaration. In this case, there was no clear finding that the broker knew the container contained poppy seeds or that documents were false. The Court noted that industry practice allows Customs Brokers to initially pay logistics or shipping charges and later recover them from clients. Drawing adverse inference solely on this basis was unjustified. The Court also questioned why penalties imposed on the broker were higher than those imposed on the importer, despite the importer being described as the mastermind, and found no reasoning provided for such disparity. The Court reiterated that mere facilitation or procedural involvement is insufficient to establish abetment. Penalties in quasi-criminal proceedings require clear findings of intentional aiding or knowledge of illegality. Without these jurisdictional facts, the imposition of penalty is legally unsustainable. Finding the adjudication order to be unreasoned and unsupported by evidence of knowledge or intent, the High Court set aside the penalties imposed on the petitioner.
