Mixed Iron Ore Consignments To Be Treated As Iron Ore Fines: CESTAT

The Hyderabad Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has held that mixed consignments containing iron ore fines and iron ore lumps cannot be split and subjected to separate export duty treatment. The bench of Angad Prasad (Judicial Member) and A.K. Jyotishi (Technical Member) ruled that where iron ore fines predominate in a mixed consignment, the entire consignment should be treated as iron ore fines for levy of export duty. However, while granting partial relief, the Tribunal also upheld the invocation of the extended limitation period and penalty proceedings after finding that material facts had not been correctly disclosed at the time of export. The dispute arose in an appeal filed by M/s RB Seth Shreeram Narsingdas against an Order-in-Original confirming customs duty demand of ₹85.11 lakh along with applicable interest and equivalent penalty. The case involved exports of iron ore fines and lumps during the period from 2008–09 to 2011–12. At the time of export, shipping bills were self-assessed and filed on the basis of declared parameters such as iron (Fe) percentage, moisture content and unit price. Subsequently, the department sought final invoices and analytical reports after suspecting that the declarations were based only on provisional invoices and may not reflect the actual position. Upon scrutiny of the export documents and discharge-port reports, the department observed variations in moisture content, Fe content and other parameters when compared with the details originally declared in the shipping bills. It was alleged that the declarations made during export did not match the final position emerging from discharge-port analyses and realized values. Based on these findings, a show cause notice was issued proposing reassessment of shipping bills and recovery of differential duty under the Customs Act. The department's differential duty demand was broadly based on three grounds. Firstly, certain quantities were treated as iron ore lumps and subjected to a higher export duty rate. Secondly, export duty was recalculated based on Fe content and moisture percentages determined later. Thirdly, the department attempted redetermination of export value on the basis of final invoice values and Bank Realisation Certificates (BRCs) instead of the initially declared provisional values. The Tribunal examined previous decisions dealing with similar issues and noted that the legal position had largely been settled. It observed that where consignments contain a mixture of iron ore fines and iron ore lumps, the goods cannot be artificially segregated for applying different duty rates. Instead, the classification must be determined according to the predominant character of the goods. While discussing moisture and Fe content issues, the Tribunal acknowledged that the export transactions had originated from self-assessment and provisional declarations. The Bench noted that contractual arrangements themselves contemplated final determination of parameters at the discharge port. Nevertheless, the Tribunal distinguished between reassessment and finality of self-assessment and observed that once shipping bills had undergone final assessment, certain parameters originally declared could not be freely reopened. The Tribunal also rejected the argument that BRC values alone should determine assessable value. The Bench noted that realization reflected in BRCs did not necessarily establish receipt of the entire amount and therefore could not automatically replace the value originally declared for assessment purposes. On limitation and penalty, the Tribunal sided with the department. It observed that discrepancies in export-related declarations became apparent only after the final invoices and discharge-port documents were examined. According to the Bench, there was withholding of material information because the invoices were provisional and subject to contractual variations, yet these aspects were not properly disclosed at the stage of self-assessment. Consequently, the Tribunal found no infirmity in the invocation of the extended period or in the imposition of penalty. The Tribunal held that mixed consignments of iron ore fines and lumps must be treated as iron ore fines, moisture variation affecting quantity would not matter where duty is ad valorem, Fe content as declared at the time of export would govern assessment, and BRC values by themselves could not determine assessable value. Since differential duty still required recalculation in light of these principles, the matter was remanded to the adjudicating authority for fresh determination. The appeal was accordingly allowed by way of remand.
