Can Interest Be Waived on Delayed Service Tax Payment by a Govt. Dept.? CESTAT Says No

The Allahabad Bench of the Customs, Excise & Service Tax Appellate Tribunal (CESTAT) has held that a government department cannot escape payment of statutory interest merely because the delay in depositing service tax was caused by bureaucratic procedures and administrative hurdles. The bench of Sanjiv Srivastava (Technical Member) dismissed the appeal filed by the Head Post Master, Etawah, and upheld the recovery of interest on delayed payment of service tax, reiterating that interest is compensatory in nature and becomes automatically payable once tax is deposited after the prescribed due date. The case arose from an investigation conducted by the Directorate General of GST Intelligence (DGGI), Kanpur. During scrutiny of records, authorities found that the postal department had failed to pay service tax amounting to ₹33.35 lakh on various postal and courier-related services rendered between April 2014 and June 2017. It was also found that ST-3 returns had not been filed for the relevant period. Consequently, a show cause notice was issued demanding service tax, interest, and penalties under the Finance Act, 1994. After adjudication, the department confirmed a service tax demand of ₹10.16 lakh for the period October 2016 to June 2017, appropriated the amount already deposited by the appellant, ordered recovery of interest under Section 75 of the Finance Act, and imposed penalties. On appeal, the Commissioner (Appeals) waived the penalty imposed under Section 78 as well as the penalty for late filing of returns, taking note of the fact that the appellant was a government department and there was no evidence of fraud, suppression, or deliberate tax evasion. However, the appellate authority maintained the demand for interest, holding that interest on delayed payment of tax is mandatory. The appellant argued that it was a department of the Government of India and had no intention to evade tax. According to the appellant, the delay occurred because service tax payments were required to be made through internet banking, whereas departmental procedures did not readily permit such transactions. The postal department contended that it repeatedly approached the State Bank of India and also wrote several letters to Central Excise authorities seeking permission to deposit tax through cheques under Rule 6(2) of the Service Tax Rules, 1994. Since neither the bank accepted the cheques nor the department provided timely approval, the payment was delayed. It was argued that the delay was purely procedural and administrative and therefore interest should not be recovered. The Tribunal noted that there was no dispute regarding the fact that service tax had been collected from service recipients and that the tax amount was deposited much after the statutory due date. The service tax liability of ₹10.16 lakh relating to October 2016 to June 2017 was ultimately discharged only in February 2021. Member (Technical) Sanjiv Srivastava observed that even if the delay resulted from bureaucratic processes, administrative hierarchy, or communication issues within government systems, such circumstances could not override the statutory mandate contained in Section 75 of the Finance Act, 1994. The Tribunal emphasized that the law requires every person liable to pay service tax to also pay interest whenever the tax is not credited to the Government within the prescribed period. Once delay is established, interest follows automatically. The Tribunal relied heavily on the Supreme Court's landmark decision in Pratibha Processors Judgment, where the Court distinguished between tax, interest, and penalty. The Supreme Court had held that tax is the amount payable under the charging provision. Penalty is imposed for deliberate violations or contumacious conduct. Interest is compensatory in nature and is charged because tax due to the Government remained unpaid for a period of time. The Tribunal also referred to the Supreme Court ruling in Steel Authority of India Ltd. Judgment and earlier tribunal decisions to reiterate that interest liability is independent of the reasons for delayed payment and arises automatically once tax is paid beyond the due date. A key takeaway from the ruling is the Tribunal's observation that bureaucratic delays, internal approvals, procedural constraints, or communication issues within government departments cannot be treated as valid grounds for waiver of statutory interest. The Tribunal observed that while such delays may explain the circumstances leading to late payment, they do not extinguish the statutory obligation to compensate the Government for the period during which the tax remained unpaid. Finding no legal infirmity in the order of the Commissioner (Appeals), the Tribunal dismissed the appeal and upheld the recovery of interest under Section 75 of the Finance Act, 1994. The Tribunal concluded that delayed payment of service tax inevitably attracts interest, regardless of whether the assessee is a private entity or a government department.
