Extended Limitation Can’t Be Invoked in CERA Audit-Based Dispute: CESTAT

The Chennai Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has held that the extended period of limitation could not be invoked when the dispute itself originated from a Central Excise Revenue Audit (CERA) objection that was not accepted by the department. The bench of P. Dinesha (Judicial Member) and M. Ajit Kumar (Technical Member) has observed that limitation goes to the very root of jurisdiction and therefore must be examined before considering the merits of the dispute. Relying on various Supreme Court decisions, the Bench emphasized that if a proceeding is barred by limitation, the adjudicating authority lacks jurisdiction to decide it on merits. The appellant, Precision Equipments Chennai Pvt. Ltd. is engaged in the manufacture of heat exchangers and also undertakes job-work activities for various clients. The department alleged that certain job-work operations undertaken by the company did not amount to “manufacture” and were therefore taxable under the category of Business Auxiliary Service (BAS) under Section 65(19) of the Finance Act, 1994. Based on this view, a show cause notice dated May 21, 2007 was issued demanding service tax of ₹4.54 lakh along with interest and penalties for the period from September 10, 2004 to March 31, 2006. The adjudicating authority confirmed the demand and imposed penalties under Sections 77 and 78 of the Finance Act, 1994. The Commissioner (Appeals) subsequently upheld the order, leading the assessee to approach the Tribunal. Before the Tribunal, the appellant strongly contested the invocation of the extended period of limitation. It argued that the demand originated from a CERA audit objection and that the department itself had disputed the audit objection and kept the matter in the call book. Therefore, there could be no allegation of suppression of facts or intent to evade tax. The assessee further contended that the dispute involved interpretation of the scope of Business Auxiliary Service and whether job-work activities amounted to manufacture. According to the appellant, such interpretational disputes cannot justify invocation of the extended limitation period. Apart from limitation, the appellant also argued that during part of the disputed period, BAS covered only “production of goods on behalf of the client” and not mere processing of goods. The expressions “processing of goods” and “for the client” were specifically introduced into the BAS definition only from June 16, 2005. Certain activities amounted to manufacture and were therefore outside the scope of service tax. Excise duty had already been discharged on the products involved. The department argued that the appellant had failed to produce adequate documentary evidence to establish payment of excise duty or to prove that the activities amounted to manufacture. It also maintained that production and manufacture were substantially synonymous in the context of BAS and that the activities were taxable. The department further defended invocation of the extended period by relying on judicial precedents concerning suppression of facts and non-disclosure. The Tribunal noted that the disputed period ended on March 31, 2006, while the show cause notice was issued only on May 21, 2007, beyond the normal limitation period then applicable. Consequently, the validity of the demand depended entirely upon whether the department could legitimately invoke the extended period. A crucial factor influencing the Tribunal’s decision was the department’s own acknowledgment in the adjudication order that the show cause notice had been issued solely because of a CERA audit objection and that the department itself had disputed the objection. The matter had consequently been placed in the call book pending clarification. The Bench observed that this clearly demonstrated that the issue was interpretational in nature and that the department’s understanding was substantially aligned with the assessee’s position. In such circumstances, the allegation that the assessee had suppressed material facts was untenable. According to the Tribunal, when the department itself was unconvinced about the correctness of the audit objection, it could not subsequently attribute suppression or deliberate non-disclosure to the taxpayer merely because the audit had raised a contrary view. The Tribunal also criticised the adjudicating authority for failing to provide a reasoned analysis supporting the allegation of suppression. It noted that the order merely stated that the appellant had suppressed information and that the non-payment would have gone unnoticed but for the audit, without explaining how deliberate concealment was established. The Bench reiterated that judicial and quasi-judicial orders must contain clear reasons reflecting application of mind. Referring to established jurisprudence, it observed that reasons constitute the “lifeblood” of adjudicatory orders and cannot be replaced by conclusory statements. Holding that the extended period of limitation was wrongly invoked, the Tribunal concluded that the show cause notice was time-barred. Since the demand itself was unsustainable on limitation, the Tribunal found it unnecessary to examine the substantive taxability issues raised by the parties. The CESTAT set aside the impugned order and allowed the appeal with consequential relief to Precision Equipments Chennai Pvt. Ltd. in accordance with law.
