Karnataka High Court Quashes Dismissal of Central Tax Superintendent in Red Sanders Valuation Case

The Karnataka High Court has set aside the dismissal of K. Ananthapadmanabha, a Superintendent of Central Tax in a case arising out of allegations relating to illegal export of red sanders and valuation-related issues, holding that the disciplinary authority proceeded without granting the officer a requested personal hearing. The bench of Justice S.R.Krishna Kumar has observed that subsequent developments, including the officer’s discharge in criminal proceedings and the remand of customs adjudication proceedings for fresh consideration, could have a direct bearing on the disciplinary action and therefore warranted reconsideration of the dismissal order. The case arose from disciplinary proceedings initiated against Shri K. Ananthapadmanabha Rao, a Superintendent of Central Tax, who challenged an Order-in-Original dated 10 November 2025 dismissing him from service. The petitioner sought quashing of the dismissal order, reinstatement with retrospective salary benefits, and alternative relief concerning proceedings before the Central Administrative Tribunal. According to the record, disciplinary proceedings had commenced through a charge memorandum issued on 10 October 2023. Following an enquiry report dated 27 December 2024, a disagreement note was issued on 31 March 2025 holding that charges framed against the officer stood proved. A major contention raised before the High Court was that the disciplinary authority proceeded to pass the dismissal order despite a written representation submitted by the petitioner requesting a personal hearing. The representation stated that a discharge application filed by him in pending criminal proceedings was awaiting orders and that the outcome of such proceedings would significantly affect the disciplinary matter. The officer had sought an opportunity to place those developments on record before any final decision was taken. The petitioner argued that only three days after the representation was submitted, the authority issued the dismissal order without considering his request. He contended that this amounted to denial of sufficient and reasonable opportunity and violated the principles of natural justice. The High Court also considered important subsequent developments. It was brought to the Court's attention that after the dismissal order had been issued, the Special Court had allowed the petitioner’s discharge application and discharged him from criminal proceedings. The petitioner argued that such discharge would have a direct bearing on the disciplinary findings. Apart from the criminal proceedings, another significant development related to customs proceedings. The appellate authority under the Customs Act had set aside the earlier order and remanded the matter back for fresh adjudication. The petitioner contended that this too materially affected the disciplinary action taken against him. The underlying allegations related to an alleged conspiracy concerning illegal export of red sanders through misdeclaration of goods. Customs investigations had alleged involvement of various individuals and entities in facilitating the smuggling activity and penalties had also been imposed under provisions of the Customs Act. The High Court noted that the petitioner's request for personal hearing was undisputedly made before the dismissal order was passed and that later judicial and appellate developments had emerged in his favour. The Court considered these subsequent events relevant enough to potentially impact the disciplinary conclusions already reached. Observing that fairness in disciplinary proceedings remains a foundational requirement, the Court held that denying the officer an opportunity to place significant developments before the authority could not be ignored. The Court therefore set aside the dismissal order and directed reconsideration of the matter in accordance with law.
