Customs Dept. Can’t Indefinitely Suspend Cargo Licence Without Inquiry: CESTAT

The Mumbai Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has set aside an order continuing the suspension of the Customs Cargo Service Provider (CCSP) approval granted to Cargo Company holding that the Customs Department cannot continue an immediate suspension indefinitely without substantiating the grounds through the statutory inquiry mechanism prescribed under the Handling of Cargo in Customs Areas Regulations (HCCAR), 2009. The bench of S.K. Mohanty (Judicial Member) and M.M. Parthiban (Technical Member) has observed that DRI’s investigation was still underway and that a comprehensive inquiry was necessary to establish the precise role of the various individuals allegedly involved in the smuggling operation. Questions relating to unauthorized vehicle entry, seal cutting, cargo handling, security failures, and possible management involvement required proper examination through the statutory inquiry mechanism before any final action could be taken. The dispute arose after the Directorate of Revenue Intelligence (DRI) uncovered an alleged smuggling operation involving Chinese-origin firecrackers that had been misdeclared as other goods and imported through the ICTPL-operated Container Freight Station (CFS) at Nhava Sheva. According to the investigation, containers declared as “CMS Granules,” “Gypsum Plaster,” and “Household Goods” were allegedly being used to smuggle restricted Chinese firecrackers into India. Based on preliminary findings, the DRI informed Customs authorities that several operational vulnerabilities existed at the ICTPL facility, including alleged security lapses, unauthorized seal breaking, weaknesses in access control, and procedural failures that allegedly facilitated attempts to remove restricted goods from the customs area. Acting on these allegations, the Commissioner of Customs ordered the immediate suspension of ICTPL’s approval as a Customs Cargo Service Provider on April 13, 2026. Following a post-decisional hearing, the Commissioner passed a further order on May 5, 2026, continuing the suspension until further orders and prohibiting the facility from receiving fresh import or export cargo. The Commissioner observed that the case involved grave allegations of organized smuggling, systemic failures, active collusion by personnel across different operational levels, and serious breaches of cargo security and customs controls. The order also referred to alleged violations committed even after the suspension, including the acceptance of fresh cargo into the facility. Dr. Sujay Kantawala, the counsel on behalf of ICTPL challenged the continuation of the suspension before the Tribunal, arguing that it had established operational procedures, access control mechanisms, and security systems that had repeatedly passed customs audits and inspections. It had obtained international certifications, cooperated fully with investigators, provided CCTV footage and records, and made substantial procedural changes after the incident. More than 800 direct and indirect employees were being adversely affected by the continued suspension. Dr. Kantawala further contended that while certain employees might have been involved in misconduct, isolated acts by individuals could not justify the conclusion that the entire CFS lacked systems or controls. ICTPL informed the Tribunal that one Assistant Manager suspected of involvement had been terminated after becoming unavailable to investigators, while several other employees had appeared before DRI officers and cooperated with the probe. The department maintained that the suspension was justified because the case involved serious threats to customs revenue and the integrity of the customs-controlled area. The Department argued that unauthorized opening of containers, bypassing scanning requirements, entry of unauthorized vehicles and labourers, and attempted removal of prohibited firecrackers constituted severe violations warranting immediate preventive action. After examining the regulatory framework under the HCCAR, 2009, the Tribunal noted that suspension under Regulation 11(2) is an exceptional measure intended for situations requiring immediate action. However, such suspension cannot be allowed to continue indefinitely without following the detailed inquiry procedure prescribed under Regulation 12, which includes issuance of a show cause notice, appointment of an inquiry authority, collection of evidence, hearing of parties, and preparation of an inquiry report. Significantly, the Tribunal observed that Customs inspection reports available on record did not indicate any prior findings that ICTPL’s security or access control systems were inadequate. It also noted that annual inspections conducted by Customs authorities had not recorded major deficiencies relating to security and access control at the CFS. According to the Bench, the absence of adverse findings in earlier inspections weakened the justification for continuing an indefinite suspension solely on the basis of preliminary allegations. While acknowledging the seriousness of the allegations involving restricted Chinese firecrackers and emphasizing the need to safeguard customs revenue and cargo security, the Bench held that the continuation of suspension beyond a reasonable period without a completed inquiry was not consistent with the HCCAR framework. The Tribunal observed that the regulations themselves contemplate temporary restrictions and that prolonged prohibition on receipt of cargo could adversely affect trade facilitation and logistics operations. Accordingly, CESTAT set aside the Commissioner’s order dated May 5, 2026, holding that the continuation of suspension had not been adequately justified under Regulation 11. However, the Tribunal clarified that Customs authorities remain free to initiate regular inquiry proceedings under Regulation 12 and take appropriate action based on the outcome of such proceedings. Allowing the appeal, the Bench made it clear that it was not expressing any final opinion on the merits of the allegations and that the ongoing DRI investigation and any future inquiry under HCCAR would determine whether violations had actually occurred and whether further regulatory action was warranted.
