Customs Exemption Can’t Be Denied Solely for Non-Compliance with IGCR Procedures: CESTAT

The Customs, Excise & Service Tax Appellate Tribunal (CESTAT), New Delhi while the importer had failed to comply with procedural conditions prescribed under the Customs (Imports of Goods at Concessional Rate of Duty) Rules, 2017 (IGCR Rules), the benefit of exemption could not be denied because the core objective of the exemption notification had ultimately been fulfilled. The bench of Justice Dilip Gupta (President) and P.V. Subba Rao (Technical Member) has set aside a customs duty demand of ₹1.14 crore along with interest and penalty imposed on an importer of printed circuit board assemblies (PCBAs). The dispute arose from four Bills of Entry filed in July 2022 for the import of Printed Circuit Board Assemblies (PCBAs) used in networking products. The importer classified the goods under Customs Tariff Item 8517 79 10 and claimed exemption under Notification No. 24/2005-Customs. The goods were initially cleared through self-assessment without objection. Subsequently, customs authorities scrutinized the imports and alleged that the imported PCBAs were excluded from the benefit available under Entry 13S of the notification. According to the department, the goods were instead covered under another entry attracting customs duty at the rate of 10 percent. Based on this view, a show cause notice was issued seeking recovery of differential duty along with interest and penalties. The importer contested the notice, arguing that the goods did not fall within the excluded category and were therefore eligible for the exemption. During adjudication, the Commissioner accepted the importer’s contention that the goods were not among the excluded products but nevertheless denied the exemption on the ground that the importer had failed to comply with the conditions attached to the notification. Before the Tribunal, the importer argued that the adjudicating authority had travelled beyond the scope of the show cause notice. It was contended that the notice proposed denial of exemption on the basis that the goods were excluded from Entry 13S, whereas the Commissioner eventually denied the exemption for non-fulfilment of procedural conditions attached to that entry. Rejecting this contention, the Tribunal observed that an adjudicating authority is required to consider not only the allegations contained in the show cause notice but also the defence raised by the assessee. Once the importer argued that the goods were covered by Entry 13S, it became necessary to examine whether all conditions attached to that entry had also been satisfied. Therefore, the Commissioner had not exceeded the scope of the notice by examining compliance with the exemption conditions. The importer also attempted to justify its non-compliance by stating that a private publication relied upon by it had incorrectly omitted the condition attached to the exemption entry, leading to the belief that no such requirement existed. The Tribunal firmly rejected this argument, noting that exemption notifications are issued by the Central Government, published in the Official Gazette, and are readily accessible through official government platforms including the CBIC portal and e-Gazette. Any omission or error by a private publisher could not alter the legal scope or applicability of a statutory notification. Moreover, the condition had been expressly reproduced in the show cause notice itself. The Tribunal examined the structure of Entry 13S of Notification No. 24/2005-Cus. The exemption was available to specified PCBAs subject to compliance with the IGCR Rules and the furnishing of an undertaking that the imported goods would not be used in the manufacture of certain excluded telecom and networking products. The judgment discussed in detail the purpose of the IGCR Rules, which require importers claiming concessional duty benefits to provide advance information to customs authorities, execute bonds, maintain records, submit returns, and comply with monitoring requirements intended to ensure that imported goods are used only for the intended exempted purpose. According to the Tribunal, these procedural safeguards exist to prevent misuse of exemption benefits and enable customs authorities to verify post-import utilisation of goods. Having found that the importer admittedly failed to comply with the procedural requirements and did not furnish the prescribed undertaking at the time of import, the Tribunal proceeded to examine whether this lapse should automatically result in denial of the exemption. The Tribunal noted a crucial factual development. Revenue records and statements revealed that the importer was not a manufacturer but merely a trader. The imported PCBAs had been sold as such and were never used for manufacturing any of the excluded products listed in the exemption notification. Thus, the very objective underlying the condition had been achieved. The Bench observed that the exemption notification was somewhat unusual because the condition did not require the goods to be used in a particular manner; rather, it required that they should not be used for certain specified manufacturing activities. Since the importer never engaged in such manufacturing and merely traded the goods, the substantive requirement stood satisfied despite the procedural non-compliance. The Tribunal concluded that although the importer had not followed the IGCR procedure and had failed to furnish the prescribed undertaking, the purpose of the condition had been fully met. The procedural mechanism intended to ensure compliance had not been followed, but actual compliance with the substantive restriction was established on facts. The CESTAT held that denial of the exemption benefit under Notification No. 24/2005-Cus could not be sustained. The demand of customs duty, consequential interest, and penalty were therefore quashed, and the appeal was allowed with consequential relief to the appellant. Case Details Case Title: M/s.
