CESTAT Quashes Customs Duty Demand on Facsimile Machines As Dept. Failed to Prove Misclassification

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Hyderabad Bench, has set aside a customs duty demand of ₹8.55 lakh along with interest and penalty holding that the department failed to establish that the imported facsimile machines were wrongly classified. The bench of Angad Prasad (Judicial Member) and A.K. Jyotishi (Technical Member) has allowed the appeal filed by the importer and quashed the order of the Commissioner (Appeals) that had earlier upheld the demand. The dispute arose from imports made by M/s Space Technologies during 2007–08 and 2008–09. The company had imported facsimile machines and their parts from Panasonic Asia Pacific, Singapore, and classified them under Customs Tariff Heading (CTH) 8443 3260. Under this classification, the goods were eligible for exemption from Basic Customs Duty under Notification No. 24/2005-Customs dated March 1, 2005. However, the Directorate of Revenue Intelligence (DRI) initiated an investigation and alleged that the machines were wrongly classified. According to the department, the facsimile machines should have been classified under CTH 8443 3970 as machines not capable of connecting to an Automatic Data Processing (ADP) machine or network. Based on this interpretation, the department issued a show cause notice demanding differential duty along with interest and penalties. The adjudicating authority confirmed the demand and imposed a penalty equal to the duty amount. This decision was subsequently upheld by the Commissioner (Appeals), prompting the importer to approach the Tribunal. The appellant argued that the imported facsimile machines were capable of connecting to a network through external devices such as adapters, and therefore were correctly classified under CTH 8443 3260. The company contended that the tariff classification depended on whether the machine was capable of connecting to an ADP machine or network, not whether such connectivity existed internally. It was further submitted that the goods had been assessed by customs authorities at the time of import after physical verification and were cleared accordingly. Therefore, the department could not later allege misclassification without proper technical evidence. The importer also argued that the dispute was purely interpretational and involved no suppression or misstatement, making the invocation of the extended limitation period legally untenable. After examining the records and hearing both sides, the Tribunal held that the core issue was whether the facsimile machines were capable of connecting to an ADP machine or network. The bench observed that the customs tariff clearly distinguishes facsimile machines based on their connectivity capabilities. If such connectivity exists, the machines fall under the category claimed by the importer. Importantly, the Tribunal noted that the department had not produced any technical evidence to prove that the imported machines were incapable of connecting to a network or ADP machine. It reiterated the settled legal principle that the burden of proving classification under a particular tariff entry lies with the department. The bench also emphasized that the goods had been examined and assessed by customs authorities at the time of import, and were cleared after verification. The Tribunal further held that the dispute essentially involved interpretation of tariff entries and the technical functionality of the machines. In such cases, the extended period of limitation cannot be invoked in the absence of evidence of suppression or wilful misstatement. Additionally, the bench observed that Circular No. 11/2008-Cus dated July 1, 2008—relied upon by the department—could only operate prospectively, particularly if it imposed an adverse burden on the importer. The Tribunal concluded that the classification adopted by the importer was correct and that the department had failed to discharge its burden of proof.
