Cable Operators Liable for Service Tax Despite MSO Paying Tax: CESTAT

The Allahabad Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has held that a local cable operator remains liable to pay service tax on cable services provided to subscribers even where the Multi System Operator (MSO) has already discharged service tax on its own services. The bench of Sanjiv Srivastava (Technical Member) has ruled that CENVAT credit cannot be allowed when statutory conditions and time limits prescribed under the CENVAT Credit Rules are not fulfilled. The appeal was filed against an order of the Commissioner (Appeals), Allahabad, which had substantially upheld the demand of service tax, interest and penalties against a cable network operator engaged in providing cable television services in Kanpur. The department initiated an investigation after receiving information that the cable operator was providing taxable cable operator services but had not discharged service tax on the entire value of services rendered. Multiple letters and reminders were issued seeking information regarding registration, activated set-top boxes and entertainment tax payments. However, according to the department, the appellant failed to furnish the required information. Subsequently, the Commercial Tax Department furnished details of entertainment tax paid by the operator. Based on these records, the department computed the taxable value and alleged short-payment of service tax for the financial years 2016-17 and 2017-18 (up to June 2017). A show cause notice dated 15 April 2019 proposed recovery of service tax amounting to ₹1.52 lakh along with interest and penalties on the ground that the operator had suppressed facts and failed to pay the correct tax liability. One of the principal contentions raised by the appellant was that the MSO had already paid service tax on the transmission services and therefore demanding tax again from the local cable operator amounted to double taxation. The Commissioner (Appeals), whose findings were extensively examined by the Tribunal, rejected this argument. The appellate authority analysed the statutory framework under the Finance Act, 1994 and the Cable Television Networks (Regulation) Act, 1995 and concluded that a local cable operator (LCO) independently provides taxable cable services to end subscribers. The authority noted that the MSO receives signals from broadcasters and thereafter transmits them to local cable operators. The local cable operator, in turn, retransmits the signals to the final subscribers and therefore falls squarely within the definition of a "cable operator" under the law. Consequently, both the MSO and the local cable operator provide distinct taxable services in the service chain. Reliance was placed on various judicial precedents, including decisions of the Delhi High Court and earlier CESTAT rulings, holding that local cable operators are independently liable to service tax on services rendered to subscribers. The appellate authority further referred to the Punjab & Haryana High Court decision in Aameet Puri v. Union of India, which had rejected the contention that service tax was being levied twice on the same service. The High Court had observed that CENVAT credit mechanisms existed to avoid cascading effects and therefore the plea of double taxation lacked merit. Based on these principles, the Commissioner (Appeals) held that the appellant's argument that payment of service tax by the MSO absolved the local cable operator of liability was unsustainable. The Commissioner (Appeals) also examined whether the appellant could claim the threshold exemption available under Notification No. 33/2012-ST. It was held that the appellant was not providing any branded service merely because signals were received from an MSO. Accordingly, the appellant could, in principle, avail the exemption subject to satisfaction of prescribed conditions. However, since the appellant's taxable receipts during FY 2016-17 exceeded ₹10 lakh, the threshold exemption was not available for FY 2017-18. A major issue before the Tribunal concerned the appellant's claim for CENVAT credit of service tax paid by the MSO. The Commissioner (Appeals) acknowledged that, as a matter of principle, service tax paid by the MSO on signals supplied to the local cable operator could qualify as input service credit. However, the appellant had neither maintained proper CENVAT records nor filed statutory ST-3 returns claiming such credit within the prescribed period. The authority therefore held that the appellant had failed to satisfy the mandatory requirements of Rules 4(7), 9(6) and 9(9) of the CENVAT Credit Rules, 2004 and was consequently not entitled to the benefit of credit. The Tribunal agreed with this reasoning and observed that credit must be availed strictly in accordance with statutory provisions and within the prescribed time limits. It relied on the Larger Bench decision in Kusum Ingots & Alloys Ltd. as well as the Supreme Court's judgment in Osram Surya Pvt. Ltd., both of which affirmed that credit cannot be taken beyond the period stipulated under the law. The Tribunal also referred to the Allahabad High Court decision in Rathi Ispat Ltd., which emphasized that limitation provisions governing credit claims are mandatory and do not admit exceptions unless specifically provided by statute. The Tribunal found that the appellant had failed to pay service tax and file ST-3 returns for the period April 2017 to June 2017. Since the show cause notice was issued on 15 April 2019, within the normal limitation period of thirty months from the relevant date, the demand was held not to be time-barred. While largely affirming the departmental action, the Tribunal noticed that for FY 2016-17 the appellant had actually paid service tax in excess of the amount required. The adjudication records showed excess payment of ₹2,534 during that year. The Tribunal directed that this excess amount should be adjusted against the service tax demand relating to April 2017 to June 2017. Apart from granting this adjustment, the Tribunal upheld the findings regarding tax liability, denial of CENVAT credit and penalties. The CESTAT ultimately held that local cable operators are independently liable for service tax on services provided to subscribers notwithstanding the tax already paid by MSOs. The Tribunal also reaffirmed the settled principle that CENVAT credit is a statutory benefit that must be availed strictly within the time limits and procedural requirements prescribed under the CENVAT Credit Rules. Except for allowing adjustment of excess tax already paid, the appeal was substantially rejected.
