Online Coaching Taxable as Commercial Training Service, Not OIDAR: AAR

The Rajasthan Authority for Advance Ruling (AAR) has held that online coaching services provided by Allen Career Institute Private Limited are taxable as “Commercial Training and Coaching Services” under SAC 999293 and not as Online Information and Database Access or Retrieval (OIDAR) services under HSN 998433. The bench of Utkarsha and Dr. Akhden Charan clarified that the institute would be liable to pay 9% Central GST (CGST) and 9% Rajasthan State GST (SGST) even in cases where students receiving the online coaching are located outside Rajasthan. Allen Career Institute approached the AAR seeking clarity on two major issues arising from its digital coaching model. The institute asked whether online training services delivered through live and recorded digital platforms should qualify as OIDAR services or fall under commercial coaching services. It also sought a determination on GST liability where students are located outside Rajasthan. The applicant argued that its digital platform enabled students to access recorded lectures, online study material, tests, and digital educational tools through the internet. Based on this structure, the institute sought clarity regarding the applicable service classification and place of supply provisions under the Integrated Goods and Services Tax (IGST) Act. The Authority closely examined the nature of the services offered by the coaching institute and observed that the core objective of the platform was not mere online access to digital content but targeted educational coaching aimed at helping students crack competitive examinations. The AAR noted that the courses were specifically designed around examination targets and academic years, such as “Target 2026”, “Target 2027”, and similar structured coaching programs. According to the ruling, such services involve substantial human participation and personalized guidance rather than automated digital content delivery. The Authority observed that the online classes included live doubt-solving sessions where students directly interacted with tutors and received immediate clarification. It further noted that students could upload questions through AI-enabled doubt-solving modules and receive tailored responses, indicating an interactive coaching ecosystem rather than passive content consumption. The ruling emphasized that OIDAR services generally involve automated digital supplies with minimal human intervention. The Authority referred to examples where services like live medical consultations, legal advice through email, or professional consultations delivered online are not considered OIDAR because human expertise forms the core of the service. Applying the same reasoning, the AAR held that Allen’s coaching model depended heavily on teachers, tutors, and interactive educational engagement. Therefore, the services could not be categorized as online video content or database retrieval services. The Authority further observed that the institute also supplied printed study materials to students through physical courier services. This physical component, according to the ruling, reinforced the conclusion that the overall supply was not entirely electronically mediated, which is a key requirement for classification as OIDAR. On the issue of tax liability, the Authority examined the place of supply provisions under Section 12 of the IGST Act. The AAR rejected the institute’s reliance on the general place of supply provision under Section 12(2), holding that training and coaching services are specifically governed by Section 12(5). Under Section 12(5)(b), the place of supply for training services provided to unregistered persons is the location where the services are actually performed. The Authority noted that Allen’s faculty, technical infrastructure, content development, administrative operations, and dispatch of study materials were all centralized in Kota, Rajasthan. Therefore, it concluded that the coaching services were actually performed in Rajasthan irrespective of the location of the students consuming the content. Since both the location of the supplier and the place of supply were held to be within Rajasthan, the transaction qualified as an intra-State supply under Section 8(2) of the IGST Act. Based on this interpretation, the AAR ruled that online coaching services provided to unregistered students residing outside Rajasthan would still attract 9% CGST and 9% SGST instead of IGST. The ruling may have significant implications for the rapidly expanding edtech and online coaching sector, particularly for institutions operating centralized digital coaching models across India. The decision draws a distinction between automated digital content services and interactive educational coaching involving substantial human participation. The Rajasthan AAR ultimately ruled the services provided by Allen Career Institute are classifiable as “Commercial Training and Coaching Services” under SAC 999293. The services do not qualify as OIDAR services. Online coaching services supplied to students located outside Rajasthan would attract 9% CGST and 9% SGST where the recipient’s location is available on record and the services are performed from Rajasthan.
