Madhya Pradesh High Court Stays GST Demand For Grant Of Mining Lease/Royalty

The Jabalpur Bench of Madhya Pradesh High Court has stayed the GST demand for grant of mining lease/royalty.

The bench of Justice Sanjeev Sachdeva and Justice Vinay Saraf while reserving the right of the respondent-department to move for vacation of ad interim stay, the court directed that in the proposed recovery of GST on royalty shall remain stayed.

Swapnil Sohgaura, the Counsel for the petitioner while informing the Jurishour.in has stated that no doubt the Supreme Court has upheld the levy of GST on royalty paid for mining rights basis, however, the issue related to the retrospective or prospective applicability of GST on mining lease/royalty is still pending before the Supreme Court.

Mr. Sohgaura added that the dispute pertains to the period of 2018-19, and 2020-21 when the issue of GST on grant of mining lease/royalty was not decided by the Supreme Court.
