Ghaziabad Commissionerate: Court Rejects Bail Plea of GST Consultant Accused in Fake ITC Scam

The Court of Additional Sessions Judge, Meerut rejected the bail application of Deepak Kumar, a Ghaziabad-based consultant arrested in connection with an alleged multi-crore fake GST Input Tax Credit (ITC) scam.

According to the prosecution, Kumar was not merely a consultant but the mastermind controlling a cartel of at least 17 fake firms engaged in circular trading. Investigators claim he orchestrated fraudulent ITC transactions worth nearly ₹29.81 crore and filed refund claims that caused a significant loss to the government.

Searches at his Indirapuram residence and other connected premises allegedly led to the recovery of incriminating material, including electronic devices, rubber stamps of numerous firms, forged documents, and financial records. Officials further claimed Kumar had changed his surname from “Dhembla” to “Kumar” to hide his past, where he had been declared a proclaimed offender in a COFEPOSA-related case.

Kumar’s counsel argued that the arrest was illegal and unconstitutional, asserting that he had been detained for over 30 hours without warrant before being formally arrested. They also stressed that offences under GST are compoundable, with a maximum punishment of five years, and therefore bail should be granted. The defence maintained Kumar was “merely a consultant” with no ownership or operational control over Marvel Impex or other alleged shell firms.

After considering arguments from both sides, the court held that the allegations involved a grave economic offence and that Kumar’s release could affect the investigation. Accordingly, the bail application of the applicant accused Deepak Kumar was rejected.
