Supreme Court to Decide: Chartered Flight or Passenger Transport? GST ITC Implications at Stake

A tax dispute is set to come before the Supreme Court, which could have far-reaching implications on the treatment of chartered flight services under the GST regime. The central question before the Court is whether a chartered flight should be classified as a “passenger transport service” or as a “supply of tangible goods”.

The bench of Justice Manoj Misra and Justice Ujjal Bhuyan has listed the matter on 25.09.2025.In the meantime, if the respondent(s) have not filed written submission(s), they may do so by the next date of hearing.

The case itself arises under the pre-GST service tax framework, but experts note that the eventual ruling will directly impact how such services are interpreted under GST law.

At the heart of the matter lies the distinction. If a chartered flight is treated as passenger transport, it could fall under the eligible category for Input Tax Credit (ITC). However, if the service is seen as charter hire or supply of tangible goods, then it may attract restrictions under the blocked credit provisions, thereby denying ITC.

Tax professionals are closely watching the case, as the aviation sector, corporate houses, and even government entities frequently rely on chartered flight services. A clarification from the Supreme Court is expected to settle the ambiguity, providing much-needed certainty in classification and ITC eligibility.

Industry insiders believe that the ruling will not only guide pending disputes from the earlier tax regime but also serve as a precedent for GST-era assessments where similar classification challenges continue to arise.

The verdict, once pronounced, is likely to have substantial revenue and compliance implications, particularly for businesses engaging charter services for official travel and logistics.
