Income Tax Prosecution Quashed: Madras HC Holds Complaint Without Jurisdiction & Prior Assessment Is Abuse of Process

The Madras High Court has quashed criminal proceedings initiated against an assessee for alleged failure to file income tax returns, holding that prosecution without jurisdiction, proper assessment, and initiation of penalty proceedings amounts to abuse of process of law. The bench of Justice G.K. Ilanthiraiyan has observed that only the Assessing Officer vested with jurisdiction under the Act can initiate such proceedings. It noted that no order transferring jurisdiction from the Income Tax Officer to the Assistant Commissioner had been passed under Section 127. Therefore, initiation of prosecution by an Officer lacking jurisdiction was held to be invalid. The case arose from a petition filed under Section 482 of the Code of Criminal Procedure seeking quashing of proceedings in EOCC pending before the Additional Chief Metropolitan Magistrate (Economic Offences), Egmore, Chennai. The prosecution had been launched under Section 276CC of the Income Tax Act for alleged wilful failure to file returns for Assessment Year 2014–15. The Income Tax Department alleged that the assessee had failed to file returns despite engaging in a high-value transaction involving sale of immovable property worth ₹75 lakh during the relevant financial year. Based on this, prosecution proceedings were initiated after issuance of a show cause notice. It was argued that the Income Tax Officer of the relevant ward alone had jurisdiction over the case and had, in fact, issued the show cause notice. However, the complaint was filed by the Assistant Commissioner of Income Tax without any valid transfer of jurisdiction under Section 127 of the Act. The petitioner further submitted that the return was subsequently filed and taxes along with interest were paid. It was also argued that there was no wilful default and no penalty proceedings were initiated, thereby negating the ingredients required for prosecution under Section 276CC. The Department defended the prosecution, arguing that failure to file returns within the prescribed time constitutes an offence irrespective of subsequent compliance. It further contended that sanction for prosecution had been duly obtained from the Principal Commissioner of Income Tax as required under Section 279(1), and that any Income Tax authority could initiate prosecution once such sanction is granted. The Department also relied on statutory presumptions under Section 278E regarding culpable mental state, arguing that such issues must be examined during trial and not at the quashing stage. The High Court framed two primary issues: whether the respondent had jurisdiction to initiate prosecution, and whether prosecution could be sustained without initiation of penalty proceedings. The Court further observed that the sanction granted by the Principal Commissioner suffered from non-application of mind, particularly on the question of jurisdiction. On the requirement of prior assessment, the Court emphasized that determination of tax liability through regular assessment is essential before initiating prosecution under Section 276CC. In the absence of such assessment, it cannot be concluded whether the tax liability exceeded the statutory threshold for prosecution. The Court also held that failure to initiate penalty proceedings under the Act weakens the prosecution. Relying on the Supreme Court’s ruling in K.C. Builders v. ACIT, the Court observed that continuation of prosecution without penalty proceedings would render the trial an “idle and empty formality.” The Madras High Court held that the continuation of criminal proceedings would amount to abuse of process of law. Accordingly, the Court quashed the prosecution in EOCC No. 42/2019 and allowed the petition.
