Exporter Can’t Escape Liability Due to Foreign Seizure of Contraband: CESTAT Upholds Penalty in Ketamine Smuggling

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), New Delhi, has upheld a penalty against an individual found involved in the fraudulent export of Ketamine to China under the false declaration of Alpha Olefin Sulphonate (AOS), holding that exporters cannot evade liability merely because the contraband was detected and seized abroad rather than in India. However, the Tribunal reduced the penalty from the amount originally imposed by the adjudicating authority. The bench of Rajeev Tandon (Technical Member) has found that the export operation involved a sophisticated scheme using forged documents, fraudulent bank accounts, identity theft, and misuse of an existing IEC. Multiple fictitious individuals appeared in the appellant's narrative, but none could be produced before investigators, reinforcing the conclusion that false identities were used to conceal the operation. The case originated from intelligence received from the Consulate General of India in Hong Kong regarding the export of Ketamine from India to China in the guise of Alpha Olefin Sulphonate (AOS). Chinese authorities seized 1,010 kilograms of Ketamine from a consignment declared as 7,500 kilograms of AOS that had been exported under the name of M/s Vikas Overseas. Investigations revealed that the firm had ceased business operations years earlier and that its Import Export Code (IEC) had been fraudulently used for multiple exports. Customs authorities alleged that Devinder Pramod, along with a co-noticee, fabricated export documents, misused the IEC of Vikas Overseas, and orchestrated the export operation through forged records and fictitious identities. The Commissioner of Customs had imposed penalties under Section 114 of the Customs Act and also imposed a redemption fine. The appellant challenged the order before CESTAT. Before the Tribunal, the appellant argued that he was merely a commission agent who coordinated procurement and logistics for exports and had no ownership or control over Vikas Overseas. He contended that the case rested solely on information received from Chinese authorities and that there was no direct evidence proving that Ketamine had been exported from India. The appellant further argued that customs authorities had allowed the export after clearance and that, at the relevant time, Ketamine was not classified as a prohibited or dutiable item under Indian law. He also emphasized that no export incentives had been claimed and maintained that he only rendered services to the co-noticee. The Tribunal, however, found substantial evidence demonstrating the appellant's active participation in the export operation. Statements recorded during the investigation revealed that he arranged procurement of goods, coordinated logistics, hired storage facilities, facilitated customs clearance through freight forwarders and Customs House Agents (CHAs), and handled export-related documentation. Witness testimonies, including those of freight forwarders, CHA employees, bank officials, and other individuals involved in the transaction chain, consistently pointed to the appellant's central role in executing the exports. Investigators also found that export proceeds were received through a fraudulently opened bank account operating under the name of Vikas Overseas. The Tribunal observed that the appellant's defence that he was merely a broker was unconvincing and contradicted by extensive documentary and oral evidence on record. It noted that he had received monetary compensation linked to the exports and had knowledge of suspicious cargo contents. One of the key legal issues before the Tribunal was whether customs violations could be established when the contraband was detected and seized outside India. Rejecting the appellant's argument, CESTAT held that once a consignment exported from India is seized abroad and found to contain misdeclared prohibited goods, such facts relate back to the export itself and can form the basis for action under Indian customs law. The Tribunal emphasized that reports received from foreign customs authorities through official diplomatic channels possess significant evidentiary value, particularly in matters involving narcotics and psychotropic substances. Relying on established legal principles, the Tribunal observed that direct evidence is rarely available in smuggling cases and that circumstantial evidence, corroborative statements, and the conduct of the accused are sufficient to establish involvement in illegal exports. According to the Tribunal, the export of Ketamine under the guise of AOS was a deliberate attempt to bypass regulatory controls and evade detection by customs authorities. The use of fabricated documents and false declarations significantly aggravated the offence. While upholding the findings regarding the appellant's involvement, the Tribunal found merit in one legal challenge. It held that the redemption fine imposed by the adjudicating authority was unsustainable because the goods had already been exported and were no longer available for confiscation. Since the consignment had reached China and had not been cleared on bond, redemption fine could not legally be imposed in such circumstances. Accordingly, the Tribunal set aside the redemption fine component of the order. Despite setting aside the redemption fine, CESTAT concluded that the evidence overwhelmingly established the appellant's role in masterminding and facilitating the illegal export operation. The Tribunal held that the appellant had knowingly participated in the misdeclaration and export of Ketamine and that the requisite mens rea stood clearly established. Taking into account the passage of time since the offence and the prolonged legal proceedings, the Tribunal modified the impugned order and reduced the penalty imposed on the appellant to ₹5 lakh.
