CESTAT Upholds Rejection of Simplilearn’s Service Tax Refund Appeal as Time-Barred

The Bangalore Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has upheld the dismissal of an appeal filed by M/s Simplilearn Solutions Pvt. Ltd., holding that the appeal before the Commissioner (Appeals) was filed beyond the statutory limitation period and even beyond the condonable period prescribed under law. The Tribunal, by a majority decision, ruled that receipt of the adjudication order by the company's authorized representative constituted valid service of the order under Section 37C of the Central Excise Act, 1944. The dispute arose from a refund claim filed by Simplilearn Solutions under Rule 5 of the CENVAT Credit Rules, 2004 read with Notification No. 27/2012-CE (NT). The company sought refund of accumulated CENVAT credit attributable to exported taxable services for the period October 2015 to December 2016, as it was unable to utilize the credit against domestic tax liabilities. The adjudicating authority rejected the refund claim, observing that the claim relating to services exported during the quarter October 2015 to December 2015 had been filed only on 31 March 2017 and was therefore barred by limitation. Aggrieved by this rejection, the company filed an appeal before the Commissioner (Appeals). However, the Commissioner (Appeals) did not enter into the merits of the refund claim. Instead, the appeal itself was dismissed as having been filed after a delay that exceeded the permissible statutory period. The principal issue before CESTAT was whether the appeal before the Commissioner (Appeals) had been filed within the statutory limitation period. The controversy centered on the date of communication of the Order-in-Original dated 27 December 2017. The appellant argued that the certified copy of the order was communicated only on 15 March 2018 and therefore the appeal filed on 9 May 2018 should be treated as being within time. The Revenue, on the other hand, maintained that the order had already been delivered to the company’s authorized representative on 2 January 2018 and limitation must be computed from that date. The company relied on Section 37C of the Central Excise Act, which prescribes the manner in which orders and notices are to be served. It contended that mere receipt of a copy of the order by a representative could not be treated as proper service and that limitation should begin only from the date when the order was formally served upon the company. The appellant further argued that the individual who had received the order was authorized only to attend personal hearings and not specifically authorized to receive adjudication orders on behalf of the company. Therefore, according to the company, the period of limitation could not commence from 2 January 2018. Divergence of Opinion Within the Tribunal The case witnessed a split verdict between the Judicial Member and the Technical Member. Judicial Member Favoured Remand Judicial Member P.A. Augustian observed that although the employee had appeared before the adjudicating authority, there was no specific evidence showing that he was authorized to receive orders on behalf of the company. The Member held that a valuable statutory right of appeal should not be denied merely because an employee received the order without specific authorization. The Judicial Member also relied upon precedents including Neha Cosmetics v. Commissioner of Central Excise and the Supreme Court’s judgment in Saral Wire Crafts Pvt. Ltd. v. CCE & ST, emphasizing that where a statute prescribes a particular mode of service, the same must be strictly followed. He concluded that the Commissioner (Appeals) was not justified in dismissing the appeal on limitation and remanded the matter for consideration on merits. Technical Member Upheld Dismissal Technical Member R. Bhagya Devi disagreed. The Member noted that the records clearly showed that Shri K. Siva Prasad, who appeared on behalf of the company during personal hearing proceedings, had acknowledged receipt of the Order-in-Original on 2 January 2018. Under Section 37C, service upon an authorized representative is a valid mode of communication. The Member calculated that the appeal ought to have been filed by 2 March 2018 and, at the most, within the additional condonable period ending on 2 April 2018. Since the appeal was filed only on 9 May 2018, it was beyond both the normal and condonable periods. Consequently, the Commissioner (Appeals) had no jurisdiction to entertain it. The Technical Member relied on the Supreme Court judgment in Singh Enterprises v. Commissioner of Central Excise, Jamshedpur, wherein it was held that appellate authorities created by statute cannot condone delays beyond the specific period expressly permitted by law. Owing to the difference of opinion, the matter was referred to a Third Member, Judicial Member Dr. D.M. Misra. After examining the record, the Third Member agreed with the Technical Member. He observed that Shri K. Siva Prasad was admittedly one of the authorized representatives of the company and had actively participated in the adjudication proceedings. Therefore, there was no basis to contend that he was competent to argue the case but incompetent to receive the final order. The Third Member further observed that accepting the appellant’s interpretation would lead to impractical and absurd results because orders are often handed over directly to representatives who appear before adjudicating authorities. The acknowledgment on record specifically stated that the “original order” had been received on 2 January 2018, thereby negating the contention that only a photocopy had been supplied. Consequently, the Third Member held that the order had been validly communicated on 2 January 2018 and that the appeal filed on 9 May 2018 was clearly beyond the statutory and condonable periods. In view of the concurrence between the Technical Member and the Third Member, the Tribunal passed a majority order upholding the decision of the Commissioner (Appeals). The appeal filed by Simplilearn Solutions was dismissed as barred by limitation, without examination of the underlying refund claim on merits. Case Details Case Title: M/s.
