Customs Dept. Can’t Enhance Import Value Solely on NIDB Data: CESTAT

The Chandigarh Bench of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has ruled that customs authorities cannot enhance the declared value of imported goods merely on the basis of National Import Database (NIDB) data without independent corroborative evidence. The bench of S. S. Garg (Judicial Member) and P. Anjani Kumar (Technical Member) has observed that an importer who pays enhanced duty under protest for securing clearance of goods does not lose the right to challenge such reassessment later through appellate proceedings. The ruling came while deciding six customs appeals concerning reassessment of Bills of Entry filed for imports of Light Melting Scrap Bundles and Heavy Melting Scrap imported from Singapore. The appeals arose from a common order of the Commissioner (Appeals), Chandigarh, which had upheld enhancement of assessable value and consequential differential customs duty demands. According to the facts of the case, the importer had self-assessed customs duty on the imported scrap consignments and paid duty accordingly. However, the assessing authority considered the declared values significantly lower than contemporaneous values available in NIDB records. Customs authorities raised queries through the Electronic Data Interchange (EDI) system seeking explanations regarding the lower declared price. Since no satisfactory explanation was furnished, and the importer indicated willingness to pay enhanced value under protest, customs authorities reassessed the imports and recovered differential duty amounts. The dispute before the Tribunal revolved around whether customs authorities could lawfully reject transaction values and enhance assessments based primarily on NIDB data and contemporaneous imports without following the statutory framework under customs valuation rules. The importer argued that the issue had already been decided in its own favour by the Tribunal in an earlier round of litigation involving the same controversy for a previous period. It submitted that since the legal issue remained identical, the present appeals should also be allowed on similar grounds. While examining the issue, the Tribunal relied heavily on its previous decision and also referred to an important judgment of the Delhi High Court in Niraj Silk Mills vs Commissioner of Customs and connected matters. The Tribunal noted that customs law recognizes self-assessment of imported goods and transaction value occupies a central position in customs valuation mechanisms. Any rejection of declared value must therefore satisfy statutory requirements and cannot be arbitrary. The Tribunal observed that customs authorities are required to form a reasonable and objective basis for doubting the declared transaction value. Such doubt must be supported by recorded reasons and communicated in accordance with Rule 12 of the Customs Valuation Rules. Mere suspicion or reliance on database figures does not satisfy legal requirements. An important aspect addressed by the Tribunal concerned payment of enhanced duty under protest. The department had effectively relied upon the importer's acceptance of enhanced duty at the time of clearance. Rejecting such reasoning, the Tribunal observed that payment made because of practical business compulsion cannot be interpreted as waiver of legal rights. Acceptance of enhanced assessment for obtaining release of goods does not create estoppel against an importer challenging the assessment later. The Tribunal also highlighted that customs authorities cannot rely solely on NIDB data for reassessment of imported goods. Referring to earlier judicial precedents, it observed that NIDB figures by themselves cannot displace declared transaction values unless supported by independent evidence and proper comparison with genuinely identical imports. Arbitrary reassessment based only on external database values would undermine fairness and transparency in customs valuation processes. Concluding that the issue was squarely covered by earlier decisions and settled judicial principles, the CESTAT held that the impugned order was unsustainable in law. It set aside the orders of the Commissioner (Appeals) and allowed all six appeals with consequential relief as per law.
