Nikon India Loses Rs. 7.32 Crore Customs Refund On Imported Digital Cameras: CESTAT

The Customs, Excise & Service Tax Appellate Tribunal (CESTAT), Delhi has dismissed a refund claim filed by Nikon India Pvt. Ltd., despite acknowledging that the company was ultimately entitled to a customs duty exemption on imported digital cameras. The bench of Justice Dilip Gupta (President) and P.V. Subba Rao (Technical Member) has observed that Section 28 of the Customs Act deals with recovery of duties not levied or not paid or short-levied or short-paid or erroneously refunded. To issue a show cause notice under section 28 to recover duty not levied, not paid, short levied, short paid or erroneously refunded, the cause of action must have two elements- (a) the fact that duty was paid or refunded and (b) in the opinion of the proper officer issuing the notice more duty should have been paid or levied or that duty has been refunded erroneously. The bench noted that it is usually the practice of the department to keep issuing ‘show cause notices for subsequent periods or subsequent clearances’ under section 28 of the Customs Act contrary to the decisions holding the field at that time and, therefore, without a cause of action in the hope of succeeding in appeal. These, so called ‘protective demands’, i.e., show cause notices issued without cause of action will be equally covered by the judgment of the Supreme Court in Dena Snuff and even if the cause of action arises subsequently, the show cause notice cannot be issued at a time when there was no cause of action. The dispute arose from imports made by Nikon India Private Ltd., which deals in digital imaging products, including digital still image video cameras. The company had been claiming exemption from Basic Customs Duty under a government notification issued in 2005 and later amended in 2012. This exemption was initially allowed by the customs authorities for a certain period. However, following an investigation initiated by the Directorate of Revenue Intelligence, the department began to deny the benefit of this exemption from February 2014 onwards. Faced with this denial, Nikon India continued importing goods but paid customs duty “under protest,” while simultaneously requesting the authorities to issue a formal “speaking order” explaining the reassessment. Despite repeated requests, no such order was issued for a considerable period. As the statutory time limit for filing a refund claim was approaching, the company filed a refund application in July 2015, seeking recovery of approximately ₹7.32 crore paid as duty during the disputed period. Subsequently, the customs authorities rejected the refund claim in 2016 on the ground that the Bills of Entry had already been finally assessed and had not been modified through reassessment or appeal. Parallel to this, Nikon pursued legal remedies challenging the denial of exemption. While the Tribunal initially ruled against the company in 2017, a Larger Bench in 2024 reversed this position and held that the imported digital cameras were indeed eligible for exemption. This created a situation where the company had substantively succeeded on the merits of the exemption issue, but its earlier refund claim remained rejected. The Tribunal, while deciding the appeal in April 2026, focused primarily on the maintainability and timing of the refund claim, rather than the substantive entitlement to exemption. It acknowledged that the issue of exemption had eventually been decided in favour of Nikon India. However, it emphasized that the crucial question was whether the refund application filed in 2015 was valid at the time it was made. The Tribunal observed that under the law, a refund claim can only be sustained when there is a clear and established “cause of action.” In this context, a cause of action arises only when it is legally determined that the duty paid was not payable. At the time Nikon filed its refund claim, the dispute regarding exemption was still unresolved and actively under litigation. Therefore, there was no definitive legal finding that the duty collected was excessive or unlawful. Relying on the principle laid down by the Supreme Court in earlier cases, the Tribunal held that a refund application filed before the final resolution of the dispute is premature. It explained that the right to seek refund does not exist in anticipation of a favorable outcome; rather, it crystallizes only after the issue has been conclusively decided by a competent authority. Since Nikon’s entitlement to exemption was established only in 2024, the Tribunal concluded that the cause of action did not exist in 2015 when the refund application was filed. Another key observation of the Tribunal was that procedural requirements are as important as substantive rights. Even though Nikon ultimately proved that it was entitled to the exemption, this did not automatically validate the earlier refund claim. The Tribunal stressed that legal processes under the Customs Act must be followed strictly, and relief cannot be granted if foundational procedural conditions—such as proper timing—are not satisfied. The Tribunal also addressed the argument that filing an early or “protective” refund claim should be allowed. It rejected this contention, clarifying that just as the tax authorities cannot issue demands without a valid cause of action, taxpayers too cannot seek refunds in the absence of an established legal right at that point in time. Thus, the concept of precautionary or anticipatory refund claims was not accepted. The Tribunal held that although Nikon India succeeded on the merits of the exemption issue in later proceedings, its refund claim filed in 2015 was legally unsustainable because it was premature.
