Summary in DRC-01 Can’t Replace Proper GST SCN: Gauhati High Court

The Gauhati High Court has set aside a GST demand order ruling that a summary uploaded in Form GST DRC-01 cannot substitute a legally valid show cause notice (SCN) under Section 73 of the CGST Act. The bench of Justice Sanjay Kumar Medhi observed that failure to provide a proper hearing before passing an adverse order violates statutory provisions and principles of natural justice. The dispute arose after the tax department issued a summary of show cause notice in Form GST DRC-01 on 29 September 2023 for the tax period from July 2017 to March 2018. According to the petitioner, the summary uploaded on the GST portal was not accompanied by a proper show cause notice explaining the allegations. Subsequently, an order in Form GST DRC-07 was issued confirming the demand, citing that the assessee failed to respond or make payment within the stipulated period. The firm approached the High Court contending that the proceedings were invalid because the required statutory notice had never been issued. The petitioner also argued that the documents attached to the portal were unsigned and therefore lacked proper authentication by the “Proper Officer” as required under the GST Rules. The Court framed three key issues for determination: Whether a proper show cause notice had been issued before passing the order under Section 73(9) of the GST law. Whether the documents attached to the summary in DRC-01 and the order summary in DRC-07 could themselves be treated as a valid show cause notice and order. Whether the order complied with the requirement of granting an opportunity of hearing under Section 75(4) of the GST Act. After examining the statutory framework, the Court held that Section 73 requires issuance of a formal show cause notice, while Rule 142 of the CGST Rules only mandates that a summary of such notice be uploaded electronically in Form DRC-01. The Court clarified that the summary is merely supplementary and cannot replace the primary show cause notice required by law. Even if a statement determining tax liability is attached to the summary, it cannot be treated as the show cause notice itself. Relying on judicial precedents from several High Courts, the bench reiterated that a valid SCN is essential before tax, interest, or penalty can be confirmed under GST law. Another crucial defect noted by the Court was the absence of authentication. The documents attached to the DRC-01 and DRC-07 summaries were not digitally signed or otherwise authenticated by the Proper Officer. The Court referred to Rule 26(3) of the CGST Rules, which requires that notices, certificates and orders be issued electronically with digital or e-signature. It held that such authentication is necessary to ensure the legal validity and enforceability of statutory documents. The Court also found that the proceedings violated Section 75(4) of the GST Act, which mandates granting an opportunity of hearing either when the assessee requests it or when an adverse decision is contemplated. In the present case, although the summary notice mentioned a deadline for submitting a reply, the column relating to the date and time of personal hearing was marked “NA”. The Court held that even if the taxpayer does not file a reply, the authority must grant a hearing before passing an adverse order. The High Court concluded that the proceedings were not conducted in accordance with law. It therefore set aside the impugned order dated 11 December 2023. The Court granted liberty to the tax authorities to initiate fresh proceedings in accordance with law under Section 73, if deemed appropriate. It also directed that the period between the issuance of the summary notice and the service of the High Court’s judgment be excluded while computing the limitation period for issuing a fresh notice.
