FinMin Reconstitutes Advisory Board Under Prevention Of Illicit Traffic in NDPS Law For 1 Year

The Ministry of Finance has reconstituted an Advisory Board under the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988 (PITNDPS Act) to review matters related to preventive detention in cases involving illicit drug trafficking. 

The board will be chaired by Justice Anup Jairam Bhambhani, with Justice Anish Dayal and Justice Tejas Karia serving as members.

As per the notification, the newly constituted board will function for a period of one year and will consist of three members drawn from the judiciary. 

The advisory board plays a crucial role under the PITNDPS Act, which empowers the government to order preventive detention of individuals suspected of engaging in illicit trafficking of narcotic drugs and psychotropic substances. Under the law, such detention orders must be reviewed by an independent advisory board comprising sitting or former judges to ensure that the detention is legally justified.

The latest notification has been issued in exercise of powers under Section 9(a) of the PITNDPS Act, and it supersedes the previous notification issued on February 28, 2025, except for actions already taken under the earlier order.
