Language Training for Employment Qualifies as ‘Vocational Training’: CESTAT Quashes Service Tax Demand

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Bengaluru Bench, has ruled that training in English and other foreign languages aimed at improving employment prospects qualifies as “vocational training”, and therefore is exempt from service tax under the applicable exemption notifications. The bench of Dr. D.M. Misra (Judicial Member) and Bhagya Devi (Technical Member) has observed that the courses offered by the appellants focused on improving communication skills and language proficiency, which are essential for employment in several sectors, particularly in multinational companies and BPO services. The decision came in appeals filed by M/s ICM English Centre and M/s Quick Steps (formerly ICM English Centre)challenging service tax demands raised by the Commissioner of Service Tax, Bangalore. The Tribunal allowed both appeals and set aside the tax demands, holding that the training imparted by the institutes fell squarely within the scope of a “Vocational Training Institute”. The dispute relates to the period July 2003 to March 2007 for ICM English Centre and April 2007 to September 2008for Quick Steps. The department alleged that the institutes were providing services taxable under “Commercial Training or Coaching Service” under the Finance Act, 1994 but had failed to pay service tax. Accordingly, show cause notices were issued demanding ₹34.57 lakh from ICM English Centre and ₹27.41 lakh from Quick Steps, along with interest and penalties. The adjudicating authority confirmed the demands, and the Commissioner (Appeals) upheld the orders, prompting the institutes to approach the Tribunal. The appellants argued that their courses were aimed at enhancing employability, particularly for jobs in BPOs, call centres, and other service-sector roles. The training included English communication skills, foreign languages such as German, French, and Japanese, and certain computer-related courses. They contended that such training clearly qualified as vocational training, which was exempt from service tax during the relevant period under Notification No. 9/2003-ST, Notification No. 1/2004-ST, and Notification No. 24/2004-ST. The appellants further argued that the Commissioner (Appeals) had adopted an unduly narrow interpretation of the term “vocational training institute” by holding that language training merely improved employment opportunities but did not directly enable employment. The issue raised was whether the training provided by the institutes enabled trainees to secure employment or self-employment, thereby qualifying for the vocational training exemption. Referring to the relevant notifications, the Tribunal observed that a vocational training institute is defined as a centre that imparts skills enabling trainees to seek employment or undertake self-employment directly after training. The Tribunal also relied on earlier decisions which had recognized language training as vocational training. These included cases such as Anurag Soni v. CCE, British School of Language v. CST, and Innovative Training Place Pvt. Ltd. v. CCE. The Tribunal had already held that training in English and foreign languages designed to enhance employability qualifies as vocational training, and therefore falls within the exemption. Based on the language of the exemption notifications and the judicial precedents, the Tribunal concluded that the courses offered by the appellants squarely fall within the category of “Vocational Training Institute.” The bench further held that later amendments or circulars issued by the tax authorities cannot be applied retrospectively to deny exemptions that were available during the relevant period. The Tribunal set aside the impugned orders passed by the Commissioner (Appeals) and allowed both appeals with consequential relief. Case Details Case Title: M/s.
