Inconclusive CRCL Test Report Cannot Justify Reclassification of ‘Pressed Distillate Oil’ as Base Oil: CESTAT

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Chandigarh Bench, has set aside a customs demand and penalties imposed on Delhi-based importer holding that an inconclusive laboratory report cannot form the basis for alleging misdeclaration of imported goods. The Bench of S.S. Garg (Judicial Member) and P. Anjani Kumar (Technical Member) ruled that the Central Revenues Control Laboratory (CRCL) report only stated that the sample had “characteristics of base oil” but did not conclusively certify that the goods were actually base oil instead of Pressed Distillate Oil (PDO). As a result, the Tribunal held that the charge of misdeclaration could not be sustained. The dispute arose from imports of Pressed Distillate Oil made by M/s S.K. Petrochem from M/s Om Udyog on a high-seas sale basis. The importer filed several bills of entry in 2012 and 2013 declaring the goods under Customs Tariff Heading (CTH) 27101990. Based on an intelligence alert, customs authorities drew samples and sent them to the CRCL, New Delhi for testing. The laboratory reported that the sample was a pale yellow viscous liquid composed of more than 70% mineral hydrocarbon oil and observed that it had the “characteristics of base oil.” Relying on this report, the department alleged that the importer had misdeclared base oil as pressed distillate oil, leading to a show cause notice proposing reclassification of the goods as base oil/lubricating oil; redetermination of assessable value; recovery of customs duty; and confiscation of goods and imposition of penalties The adjudicating authority confirmed the proposals and imposed a penalty exceeding ₹57 lakh on the importer along with other penalties. Meanwhile, in a related set of proceedings involving Om Udyog, the Commissioner (Appeals) dropped similar proceedings, prompting the Revenue to file appeals before the Tribunal. The appellants argued that the entire case of the department was based solely on an inconclusive chemical test report. The chemical examiner was not produced for cross-examination, despite a specific request. The CRCL report merely indicated “characteristics of base oil” without giving a definitive opinion on whether the product was actually base oil or PDO. Denial of cross-examination amounted to a violation of principles of natural justice. The Tribunal observed that the key issue was whether the imported goods declared as Pressed Distillate Oil could be conclusively classified as base oil based on the CRCL report. The Bench noted that the laboratory report only suggested that the sample had characteristics of base oil, but did not categorically conclude that the goods were base oil. Such ambiguity, the Tribunal held, cannot sustain an allegation of misdeclaration. The Tribunal further emphasized that the adjudicating authority had neither examined the chemical examiner nor allowed cross-examination, which could have clarified the findings of the test report. The Bench observed that cross-examination of the chemical examiner could have helped obtain a categorical opinion regarding the classification of the goods. The denial of this opportunity resulted in a serious miscarriage of natural justice. The Bench also relied on its earlier decision in Golden Enterprises, where similar imports and identical test reports were examined. In that case, the Tribunal had ruled that the mere presence of characteristics associated with base oil is insufficient to conclude that the imported goods are base oil. The earlier ruling had subsequently been affirmed by the Supreme Court, strengthening its precedential value. The Tribunal further noted that another coordinate Bench in JRR Associates had taken the same view, observing that a test report stating that a sample “may be base oil” implies that it may also not be base oil, making it unsuitable as conclusive evidence. Applying the same reasoning to the present case, the Bench held that the CRCL report was incomplete and non-categorical, and therefore could not form the basis of a charge of misdeclaration. The Tribunal concluded that the Revenue had failed to produce any additional evidence to establish that the imported goods were actually base oil. Accordingly, the Tribunal allowed the appeals filed by M/s S.K. Petrochem and Jeevan Jain, setting aside the Order-in-Original dated 11 April 2016. Dismissed the Revenue’s appeals against Om Udyog, thereby upholding the Commissioner (Appeals)’ decision dropping the proceedings.
