Discounts to Dealers Not Deductible from Assessable Value: CESTAT Dismisses Appeals on Demo Vehicle Valuation

The Chennai Bench of the Customs, Excise & Service Tax Appellate Tribunal (CESTAT) held that discounts offered to dealers on demo vehicles cannot be excluded from the assessable value for the purpose of central excise duty. The bench of P. Dinesha (Judicial Member) and Vasa Seshagiri Rao (Technical Member) has observed that demo vehicles are supplied to dealers with the condition that they will be used for display, publicity, and test drives, which enhances the marketability of the product. However, such conditions do not change the nature of the goods at the time of clearance from the factory. The appeals arose from multiple Orders-in-Appeal issued by the Commissioner of GST & Central Excise (Appeals), Chennai, relating to the valuation of demo vehicles sold by the company to its dealers. The central issue before the Tribunal was whether the discounts provided by the company on vehicles supplied to dealers for demonstration purposes could be deducted from the assessable value under Section 4 of the Central Excise Act, 1944. The tax department had raised demands by alleging that the discounts granted on demo vehicles were not permissible deductions and must therefore be included in the assessable value while calculating excise duty. The appellant argued that demo vehicles and normal vehicles are essentially the same goods, and that the discounts provided to dealers were intended to compensate them for losses incurred when selling vehicles that had been used for demonstration or test-drive purposes. It was contended that the department had invoked Rule 6 of the Central Excise Valuation Rules, 2000 without identifying any additional consideration received by the manufacturer. According to the appellant, the discounts were purely commercial adjustments and therefore should not be treated as part of the assessable value. The appellant further argued that demo vehicles constitute a distinct category, as they are subject to specific internal policies, including separate documentation of engine and chassis numbers and a requirement that dealers use them for demonstration purposes. The department defended the impugned orders and relied on earlier Tribunal rulings, including Ford India Pvt. Ltd. v. Commissioner of Central Excise, Chennai and Hyundai Motor India Ltd. v. CCE & ST, where similar issues had been examined. It was argued that these precedents had already settled the legal position regarding the valuation of demo vehicles, and that the same principle should apply in the present case. After examining the submissions and reviewing earlier judicial precedents, the Tribunal observed that the issue concerning valuation of demo vehicles had already been settled by previous decisions of the Tribunal. The Bench referred extensively to the ruling in Hyundai Motor India Ltd., where it was held that the price of demo vehicles cannot be treated differently from that of normal vehicles for valuation purposes. According to that decision, demo cars are essentially the same goods as regular cars at the time of clearance from the factory. The Tribunal noted that the transaction value claimed by the manufacturer cannot be accepted when special discounts are provided for demo vehicles, since the vehicles are identical to normal vehicles and the price must therefore be aligned with the price of regular cars cleared to dealers. The Tribunal emphasized that earlier decisions in Ford India Pvt. Ltd., Hyundai Motor India Ltd., and Royal Enfield v. CCE had consistently upheld demands of differential duty where discounts were given on demo vehicles. These rulings held that the price of demo vehicles should be determined on the basis of the price of normal vehicles supplied to dealers, and that discounts granted specifically for demonstration purposes cannot be allowed to reduce the assessable value. The Tribunal also noted that the Supreme Court had dismissed the civil appeal filed in the Ford India case, reinforcing the finality of the legal position on the issue. The Tribunal held that there was no merit in the appeals filed by Hindustan Motor Finance Corporation Ltd. The CESTAT dismissed all the appeals, thereby upholding the departmental view that discounts given on demo vehicles must be included in the assessable value for excise duty purposes.
