Supreme Court Dismisses Centre’s SLP, Upholds Promotion of Sameer Wankhede

The Supreme Court dismissed the Special Leave Petition against IRS Officer Sameer Dnyandev Wankhede by affirming the judgments passed by the Central Administrative Tribunal (CAT) and the High Court of Delhi in relation to his promotion.

The bench of Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe dismissed the Special Leave Petition, observing that no case for interference was made out. The Court further clarified that the dismissal of the SLP would have no bearing on any other proceedings, if any, pending independently.

The Special Leave Petition arose from a final judgment dated 28 August 2025 passed by the Delhi High Court in W.P.(C) No. 10271 of 2025, followed by dismissal of a Review Petition on 17 October 2025. The High Court had upheld the order of the Central Administrative Tribunal granting relief to Shri Wankhede in a service matter concerning his promotion.

Aggrieved by the concurrent findings of the CAT and the High Court, the Union of India approached the Supreme Court seeking interference under Article 136 of the Constitution of India.

The Union of India was represented by Additional Solicitor General S.D. Sanjay, while Senior Advocates Paramjit Singh Patwalia and J. Sai Deepak appeared on behalf of Shri Sameer Dnyandev Wankhede.

At the outset, the Supreme Court condoned the delay in filing the petition. Upon hearing the learned counsel for the parties, the Court categorically held that it was not inclined to interfere with the impugned judgment and order in exercise of its jurisdiction under Article 136.

The dismissal of the SLP brings finality to the issue of promotion in favour of Shri Sameer Dnyandev Wankhede, IRS. The Supreme Court’s refusal to interfere conclusively upholds the legality and correctness of the orders passed by the Central Administrative Tribunal and the Delhi High Court, thereby rejecting the Department’s challenge at all judicial levels.
