Limitation Plea Can’t Be Entertained For First Time At Appellate Stage Without Supporting Facts On Record: Madras HC

The Madras High Court has dismissed a long-pending appeal filed by an assessee against an order of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT), holding that a plea on limitation cannot be entertained for the first time at the appellate stage in the absence of necessary supporting facts on record. The bench of Justice Anita Sumanth and Justice P. Dhanabal ruled in favour of the Central Excise Department and upheld the invocation of the extended period of limitation in an alleged case of duty evasion through misuse of Small Scale Industry (SSI) exemption. The appeal arose from a 2009 order of the CESTAT, Chennai, which had confirmed excise duty demands against a manufacturing unit engaged in fabrication activities. The Department had alleged that during 1995–96 and 1996–97, the assessee had floated two “shadow units” to split production and artificially remain within the SSI exemption threshold of ₹30 lakh, thereby evading payment of central excise duty. According to the Department, goods were cleared in the names of these purportedly independent units, even though all manufacturing activities were carried out from the premises of the main assessee. It was alleged that the two units neither had independent factory premises nor machinery and existed only on paper to facilitate wrongful availment of exemption. A show cause notice issued in March 2000 proposed clubbing of clearances of all three entities, denial of SSI exemption, recovery of duty by invoking the extended five-year limitation period under Section 11A of the Central Excise Act, 1944, and imposition of penalties. The adjudicating authority confirmed the demand in March 2001, and the order was upheld by the Commissioner (Appeals) in May 2002. Significantly, at no stage before the adjudicating authority or the first appellate authority did the assessee raise any objection to the invocation of the extended period of limitation. Even before the CESTAT, the appeal was argued only on merits, without taking a specific ground on limitation. The Tribunal, after recording findings of suppression and confirming that the alleged sister units were non-existent in reality, dismissed the appeal. Before the High Court, the assessee attempted to argue that the demand was time-barred, contending that the Department was already aware of the existence of the units and therefore could not invoke the extended limitation period. Two substantial questions of law were framed, focusing on whether the Tribunal was justified in rejecting the limitation plea on the ground that it had not been raised earlier. The Division Bench observed that while limitation can sometimes be raised as a pure question of law at any stage, this principle applies only when all material facts necessary to decide the issue are already available on record. In the present case, the Court found that the question of limitation involved disputed and critical factual aspects—particularly whether the Department had prior knowledge of the existence and activities of the alleged units. The Court noted that documents sought to be relied upon by the assessee to establish departmental knowledge were not shown to be part of the original record before the authorities. Moreover, while there was some indication of registration for one unit in earlier years, there was no material to establish the existence or independent functioning of the other unit during the relevant period. The High Court held that the plea of limitation was a mixed question of law and fact and could not be entertained for the first time without a proper factual foundation. The Tribunal was therefore justified in rejecting the belated oral plea on limitation and in proceeding solely on the merits of the case. Answering the substantial questions of law in favour of the Department, the Court dismissed the civil miscellaneous appeal and the connected petition, thereby affirming the excise duty demand and penalties.
